Description | Any questions or requests for clarifications shall be submitted in writing to the Architect's office no later than February 23, 2023 by emailing afinkle@ssparchitects.com Each bidder must deposit with his Bid, a security in the amount of not less than 10% of the Bid, but in no case to exceed $20,000, pursuant to N.J.S.A. 18A:18A-24, in the form of a certified check or a Bid Bond in the form provided in the Bidding Documents under Section B: "Instructions to Bidders", with corporate surety satisfactory to the Owner, naming as obligee, in favor of the Owner as a guarantee that, in case the contract is awarded to the bidder, she/he will execute such contract. The bid security is to be retained and applied as provided, in case bidder would default in executing the Agreement or furnishing the required bonds and insurance certificates as required by the Contract Documents. The successful bidder will be required to furnish a New Jersey Statutory Performance Bond and a Labor and Material Payment Bond in the amount of 100% of the contract and satisfactory in form, execution and sufficiency of surety. The Consent of Surety shall be executed by an approved Surety Company authorized to do business in the State of New Jersey. The Surety's consent and guarantee to issue the Performance Bond and Labor and Material Payment Bond must be unconditional. Submission of a Consent of Surety which contains any prior conditions upon the Surety's issuance of the required Bonds shall be cause for rejection of the Bid. All bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq., Affirmative Action Against Discrimination (N.J.A.C. 17:27-1 et seq.), Mandatory Equal Employment Opportunity Language, Americans with Disabilities Act, Statement of Ownership Disclosure (P.L. 1977, c.33, as amended by P.L. 2016, c.43), Notice of Classification, Total amount of Uncompleted Contracts Form (DPMC Form 701), Certification of No Material Change, Prevailing Wage Affidavit, Non-Collusion Affidavit, Affidavit of Bidder that he/she is not on the State of New Jersey's list of Disbarred, Suspended or Disqualified Vendors, Disclosure of Investment Activities in Iran, Disclosure of Prohibited Activities in Russia / Belarus, Federal Non-Debarment Certification, New Jersey Business Registration Certificate, and other forms as noted in the Instructions to Bidders and as required by law. All contractors are subject to background checks. Refer to Section B - Instructions to Bidders for additional information. Bidders must be registered at the time of bidding pursuant to the Public Works Contractor Registration Act, N.J.S.A. 34:11-56.48 et seq. The Owner is requesting that copies of the Certificates be included in the Contractor's Bid Package. Bidders are required to comply with the State Prevailing Wage Rate for Public Works, N.J.S.A. 34:11-56.25 et seq., as amended. All bids shall be irrevocable, not subject to withdrawal and shall stand available for a period of (60) sixty days. The Owner reserves the right to waive minor informalities or nonmaterial exceptions in, or to reject, any or all bids pursuant to N.J.S.A. 18A:18A-22, as may be permitted by law. The Franklin Township Board of Education Reserves the Right to Reject Any and All Bids, to Waive Any Informalities in Any Bid, or to Award Separate Contracts or a Lump Sum Contract (as Applicable), in Such a Manner as Shall Be, in the Judgment of the Board of Education, Deemed in the Best Interest of the School District, All in Conformity With the Law. |
