Description | No bids will be received after the hour named. The City of Newark hereinafter called the "Owner" accepts no responsibility for any submittal of bids prior to their presentation at the date and hour indicated for the formal bid opening. Arcadis U.S., Inc. is defined as the "Engineer" and representative of the Owner. In general the Work under this Contract includes construction of the fixed end-of-pipe type netting facility at the upstream end of the existing Peddie Ditch, adjacent to the existing regulator chamber in the City of Newark, New Jersey. More specifically it includes: Construction of approximately forty (40) feet wide by twenty three (23) feet long concrete apron with approximately thirteen (13) feet high concrete wing wall on each side supported on pile foundation. The concrete apron will support a new eight (8) bag netting system, associated stainless steel tubing and stainless steel bar screens. There are four (4) existing 6'-0" high by 8'-0" wide wooden tide gates located on the outside face of the existing regulator chamber wall that will be replaced with new stainless steel tide gates. Also, there is an existing eight (8) bag pontoon type wooden netting facility located within Peddie Ditch approximately hundred (100) feet downstream from the existing regulator chamber that will be demolished and removed from the Site. In addition the Work shall also include installation of all appurtenances necessary to complete the Work as shown on the Contract Drawings and outlined in the Project Manual. Contract Documents may be examined and obtained at the Department of Water & Sewer Utilities, Division of Sewers and Water Supply, 1294 McBride Avenue, Little Falls, New Jersey during regular business hours. Additional sets may be purchased for the deposit specified. No refunds will be given for the return of additional sets. It is strongly urged that prospective bidders attend both the Pre-bid Conference and the Site Visit. Each Bid shall be submitted in accordance with the Instructions to Bidders and shall be accompanied by a Bid Security in the form of a bid bond, cashier's check, or a certified check made payable to the City of Newark in an amount equal to of the amount of the total bid, but not in excess of $20,000.00. No Bidder may withdraw his/her Bid for a period of sixty (60) calendar days after the actual date of the opening of the Bids, except for reasons covered under N.J.S.A. 40A:11-23.3. with a surety company licensed in the State of New Jersey, and meets the requirements of N.J.S.A. 2A:44-143. Surety company shall also be listed on latest version of the U.S. Department of Treasury Circular 570. Complete instructions for filing Bids are included in the Instructions to Bidders. The Owner is seeking funding for this project through the New Jersey Environmental Infrastructure Trust and the New Jersey Department of Environmental Protection. The successful bidder must comply with all the provisions of N.J.A.C. 7:22-9 et. seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SEDs). The successful bidder must comply with the Project Plan provided in Attachment A for fulfilling SED utilization requirements. This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or any lower tier contract or subcontract. This contract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22- 9 All bidders must comply with N.J.S.A. 40A:11-1, as amended relative to submission of a certification of the bidder, indicating the ability to perform the Contract. The bidder, in conformance with N.J.S.A. 52:25-24.2, shall submit with its bid, a statement setting forth the names and addresses of all stockholders who own a ten percent (10%) or greater interest in the firm. The successful bidder shall be required to comply with the provisions of the New Jersey Prevailing Wage Act, N.J.S.A. 34:11-56.25 et seq. The successful bidder shall be required to comply with DavisBacon prevailing wage requirements (40 U.S.C. 3141 et seq. and 29 CFR Parts 5,6), and the higher of the state or federal wages shall apply. The Bid is subject to New Jersey Local Public Contracts Law N.J.S.A. 40A:11-1 et. seq. Bidders must comply with N.J.S.A. 52:32.44 by providing a Business Registration Certificate prior to contract award. All proposals are subject to the requirements of all laws and City of Newark Ordinances affecting it. The bidder's attention is directed to Sec. 2:4-14 of the City of Newark Administrative Code. Bidders are also advised as to the applicability of the City of Newark's Affirmative Action Program. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et. seq. and.N.J.A.C.17:27. In addition, the Contractor must certify that at least 25% of the total Contract bid price will be directed and paid to a minority business enterprise, either through joint venture arrangement, partnerships, subcontractors, the purchase of goods and services or any other method available. The term "minority business enterprise" means a business at least fifty-one (51) percent of the stock of which is owned by a minority group member. "Minority group members" are citizens of the United States, who are Black, Hispanic, Asian American, Indians, Eskimos, and Aleuts. Successful bidders shall be required to attend a meeting with, and obtain clearance from, the City of Newark's Office of Affirmative Action prior to execution of the contract. An additional seven percent (7%) of the total Contract bid price will be directed and paid to a woman's business enterprise, either through joint venture arrangements, partnerships, subcontractors, the purchase of goods and services or any other method available. The term "women's business enterprise" means a business where at least fifty-one (51) percent of the stock is owned by women. The Owner reserves the right to reject all Bids in accordance with N.J.S.A. 40A:11-13.2 and waive minor informalities.
