Description

Work includes furnishing a belt filter press, cake conveyor, polymer blending unit(s) and the accessories, features, and controls described in the specifications. Supplier shall provide materials, equipment, spare parts, start-up, training, and field-testing services, shop drawing submittals, operations and maintenance (O&M) manuals, and installation certifications. The equipment will be installed by the Contractor for the General Construction Work for the Lynn Lane WWTP Filter Press Replacement project which is to be bid and awarded at a future date. It should be noted that the General Construction Work is funded through a Clean Water State Revolving Fund (CWSRF) loan through the Oklahoma Water Resources Board (OWRB), and therefore subject to all current CWSRF requirements. The Contract for this Work will be assigned by the BAMA to the Contractor for the General Construction Work for the Lynn Lane WWTP Filter Press Replacement project. Upon such assignment, Supplier will function as a subcontractor to the Contractor, and all obligations of this Supplier to the BAMA will become obligations of the Supplier to the Contractor. Example forms for assignment of the Contract and Surety's agreement to the assignment are attached to the Procurement Contract. Project bid documents must be downloaded from QuestCDN which will add your company to the Planholder List and allow access to vBid online bidding for the submittal of your bid (which is required for this project). Bidders will be charged a fee of $30 to submit a bid electronically. FOR THIS PROJECT, BIDS WILL ONLY BE RECEIVED AND ACCEPTED VIA THE ONLINE ELECTRONIC BID SERVICE THROUGH QUESTCDN All required affidavits and Proposal Guarantees MUST be submitted through QuestCDN with bid documents. Only bids submitted as required above by 1:45 p.m. on the date of the bid opening will be considered. Bidders on this work will be required to comply with the President's Executive Order No. 11246, as amended. The requirements for bidders and contractors under this order are explained in the specifications Sworn statement of the Bidder's assets and liabilities, technical qualifications and performance in the form of the latest annual report and financial statement are not required to be submitted with the Bidder's Proposal, but BAMA may require such statements prior to award of the construction contract. The Statement of Qualifications & Experience using the form found in Section II Proposal Documents, must be submitted with the bid and include, as a minimum, the information required herein. Failure to submit the information required in these documents may result in BAMA considering the Bid non-responsive and result in rejection of the Bid by BAMA. Bidders may be required to provide supplemental information if requested by BAMA to clarify, enhance or supplement the information provided in the Statement of Qualifications & Experience. The apparent successful Bidder shall, within two (2) days after Bid opening, submit to BAMA a list of the Subcontractors, Suppliers, individuals or entities proposed for the Work. Such list shall be accompanied by a Statement of Qualifications & Experience, using the forms found in Section II Proposal Documents, with pertinent information regarding similar projects and other evidence of qualification and experience for each such Subcontractor, Supplier, or other individual or entity. If BAMA or Engineer, after due investigation, has reasonable objection to any proposed Subcontractor, Supplier, individual, or entity, BAMA may, before the Notice of Award is given, request apparent successful Bidder to submit an acceptable substitute, within one (1) day of notification. If apparent Successful Bidder declines to make any such substitution, BAMA may award the Contract to the next lowest Bidder that proposes to use acceptable Subcontractors, Suppliers, or other individuals or entities. In such event, the next lowest Bidder shall, within two (2) days after requested by BAMA, submit to BAMA the above required list of the Sub contractors, Suppliers, and other individuals or entities. Bidders must demonstrate, at a minimum, at least three successful belt filter press equipment installations that are similar in nature and scope to this project within the last five years. In evaluating whether a Bidder is responsible, BAMA will consider the qualifications and experience of the Bidder and may consider the qualifications and experience of Subcontractors and Suppliers proposed for those portions of the Work for which the identity of Subcontractors and Suppliers must be submitted as provided above. Due to social distancing requirements of the COVID-19 health crisis, bidders and other members of the public may attend and view the bid opening only through the following online access by "control clicking" on the link: Virtual bid openings | Broken Arrow, OK . The bid opening will be live-streamed and recorded. The acceptance and award of this Bid will be considered by BAMA. BAMA reserves the right to reject any or all Bids. Project will be awarded to the responsible Bidder with the lowest base bid or lowest combined base and additive alternate bids, if any, which is most advantageous to BAMA. Applicable additive alternates, if any, will be determined at BAMA's discretion. The lowest responsible Bidder will be notified within ten (10) working days of the Bid opening as to when this Public Construction Contract will be placed on the BAMA Agenda for consideration. Each bidder shall accompany his bid with a sworn statement in writing that the bidder has not directly or indirectly entered into an agreement, expressed or implied, with any other bidder concerning the price or amount of such bid or any bids, the limiting of the bids or bidders, the paying to anyone any money for promotion expenses, the parceling or farming out to any bidder or bidders or other persons of any part of the contract or any part of the subject matter of the bid or of the profits thereof. This project is to be financed by a CWSRF loan from the Oklahoma Water Resources Board (OWRB) and shall be referred to as Project No. ORF-21-0028-CW. The following requirements and regulations must be complied with: A. All laborers and mechanics employed by contractors and sub-contractors on projects funded directly by or assisted in whole or in part by and through the Federal Government shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with subchapter IV of Chapter 31 of Title 40, United States Code and 29 CFR parts 1,3, and 5. The Department of Labor provides all pertinent information related to compliance with labor standards, including prevailing wage rates and instructions for reporting. "American Iron and Steel provisions also apply to projects funded directly by or assisted in whole or in part by and through the Federal Government pursuant to P.L. 113-76, Consolidated Appropriations Act, 2014, Sec. 436 requires that "None of the funds made available by a State water pollution control revolving fund as authorized by title VI of the Federal Water Pollution Control Act (33 U.S.C. 1381 et seq.) or made available by a drinking water treatment revolving loan fund as authorized by section 1452 of the Safe Drinking Water Act (42 U.S.C. 300j-12) shall be used for a project for the construction, alteration, maintenance, or repair of a public water system or treatment works unless all of the iron and steel products used in the project are produced in the United States." "System for Award Management (SAM) registration is required for all SRF programs (CWSRF and DWSRF) applicants and Awardees (Entities, Prime Contractors, Subcontractors, Vendors) in order to be awarded contracts by the SRF Programs. SAM replaces Central Contractor Registration/Federal Agency Registration, Online Representations and Certifications Application, and Excluded Parties List System. Applicants and awardees are required to complete a one-time free registration to provide basic information relevant to procurement and financial transactions. Registrants must retain an active status to be eligible for SRF projects. New Applicants and Awardees can go to SAM.gov to complete the registration process."
