Description

Contract 3 Fortescue Wastewater Treatment Plant The Bid Award is expected to happen April 2023. The Project includes the following Work: The work includes the furnishing of all labor, materials and equipment necessary to complete the work as shown on the Drawings and as described in the Specifications. The work includes the construction of a wastewater treatment plant and effluent pump station in Fortescue to serve the communities of Fortescue and Gandy's Beach. The work shall be completed within 730 calendar days of the Contractor's receipt of written Notice to Proceed. Bids are requested for the following Contract: Contract 3 Fortescue Wastewater Treatment Plant Separate Bids will be received for the following Contracts: Contract No. Description of Contract 1 Fortescue Wastewater Collection and Conveyance System 2 Gandy's Beach Wastewater Collection and Conveyance System The non-receipt of any addenda (in the event that any addenda are issued) and the failure of the bidder to acknowledge the receipt of any and all addenda at the time of bid shall be considered a fatal defect in such Bidder's submission and said Bid shall be immediately rejected. Funding Statement The Contract is expected to be funded in part with the funds from the NJDEP, the NJIB and the USDA. Neither the United States nor the State of New Jersey, the NJIB, USDA, nor any of their departments, agencies, or employees is, or will be, a party to the Contract or any lower tier contract or subcontract. The Contract or Subcontract will be subject to regulations contained in N.J.A.C. 7:22-3.1 et seq., 4.1 et seq., 5.1 et seq., 9.1 et seq. and 10 et seq., Local Public Contracts Law, Department of Labor and Workforce Development Current Wage Rate Determination, Prevailing Wage Act, Contract Work Hours and Safety Standard Act, Copland Act, Davis Bacon Act, Buy American Clause, Debarment and Suspension, and Socially and Economically Disadvantaged (SED) (N.J.A.C. 7:22-9.1 et seq.). Pursuant to N.J.S.A. 10:5-33: "Bidders are required to comply with the requirements of P.L. 1975, c.127." All bidders are encouraged to include a commitment to the use of small, minority, women's and labor surplus area businesses and shall be in conformity with N.J.A.C. 7:22-3.17(a)(24) and 7:22-4.17(a)(24) with a goal of not less than 10% participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SED's). Further details regarding special requirements of contractors to comply with the Project Plan developed by the owner for SED participation are included in the Information for Bidders and the Supplemental General Conditions. Instructions to Bidders For all further requirements regarding bid submittal, qualifications, procedures, and contract award, refer to the Instructions to Bidders that are included in the Bidding Documents. American Iron and Steel Section 746 of Title VII of the Consolidated Appropriations Act of 2017 (Division A Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2017) and subsequent statutes mandating domestic preference applies an American Iron and Steel requirement to this project. All iron and steel products used in this project must be produced in the Unites States. The term "iron and steel products" means the following products made primarily of iron or steel: lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and Construction Materials. The following waivers apply to this Contract: De Minimis, Minor Components, Pig iron and direct reduced iron. Protected Eagles and Ospreys Acknowledgment The Contractor must follow NJDEP Regulations established under CAFRA Permit No. 0604-18-005.2 LUP210001, which was approved on October 14, 2021, and is valid until October 13, 2026. To protect sensitive habitat for the state-listed bald eagle, the Contractor shall adhere to a seasonable restriction on the use of heavy construction equipment/machinery within 1,000 feet of any active bald eagle nest along the project limit of disturbance from January 1 through July 31 of each calendar year. Additionally, the Contractor shall adhere to the Bald and Golden Eagle Protection Act and work in accordance with National Bald Eagle Management guidelines. To protect sensitive habitat for the state-listed osprey, the Contractor shall adhere to a seasonal restriction on the use of heavy construction equipment/machinery within 1,000 feet of any active osprey nest along the project limit of disturbance from April 1 through August 31 of each calendar year. The initiation and implementation of work which generates disturbance (e.g., sound levels, visual interruption) that is out of character with what currently exists at or surrounding the anticipated work area during the restricted time period recommended above may result in the Contractor being in violation of the "take" clause within state of New Jersey Endangered and Nongame Species Conservation Act (N.J.S.A. 23:2A-1). Please note that adherence to this seasonal restriction shall also be applied if nest building activity is observed at any given osprey nest location prior to April 1 of the given calendar year of work.
