240 successive calendar days after the commencement date stated in the Notice to Proceed. DESCRIPTION OF WORK: The WORK includes but is not limited to furnishing all labor, materials, equipment, services, and performing all work necessary and incidental to the construction of a new sewage force main system which includes: approximately 18,000 linear feet of new 6-inch diameter butt-fused HDPE sewer force main pipeline in open trench; approximately 1,600 linear feet of new 6-inch diameter butt-fused HDPE sewer force main installed via horizontal directional drilling methods; approximately 1,600 linear feet of new 12-inch diameter gravity sewer main via open trench or using trenchless technology; new manholes; approximately 24,500 linear feet of new fiber optic conduit and handholes and vaults; new electrical conduits for future odor control equipment; new force main pump-outs and air release vault assemblies; pavement removals and replacements; and, and stockpiling of trench excavation material . Contractor to provide all necessary work plans, permits, and inspections necessary for complete turnkey installation. SITE OF WORK: The project site is located in public right of way beginning at the intersection of Willow Road and Sundale, then along Sundale to Camino Caballo, then along Camino Caballo to Pomeroy, then along Pomeroy to Juniper, then along Jupiter to Mary Avenue, in Nipomo, California 93444. BID SECURITY: Each Bid shall be accompanied by a certified or cashier's check or Bid Bond in the amount of 10 percent of the Total Bid Price payable to the Nipomo Community Services District as a guarantee that the Bidder, if its Bid is accepted, will promptly execute the Agreement and provide all required bonds and insurance. A bid shall not be considered unless one of the forms of Bidder's security is enclosed with it. CONTRACTOR S LICENSE CLASSIFICATION: In accordance with the provisions of California Public Contract Code Section 3300, the OWNER has determined that the CONTRACTOR shall possess a valid Class A General Engineering contractor s license issued by the State of California, Contractors State License Board, at the time that bids are submitted. Failure to possess the specified license shall render the Bid non-responsive and shall bar award of the Contract to any bidder not possessing the license at the time bids are submitted. BIDS TO REMAIN OPEN: The Bidder shall guarantee the Total Bid Price for a period of 90 calendar days from the date of bid opening. BASIS OF AWARD: The OWNER will award the contract, if at all, to the responsible contractor that submits the lowest bid. CALIFORNIA WAGE RATE REQUIREMENTS: In accordance with the provisions of California Labor Code Sections 1770, 1773, 1773.1, 1773.6 and 1773.7 as amended, the Director of the Department of Industrial Relations has determined the general prevailing rate of per diem wages in accordance with the standards set forth in Section 1773 for the locality in which the WORK is to be performed. A copy of the wage rate determination is on file at the office of the OWNER. It shall be mandatory upon the CONTRACTOR to whom the WORK is awarded and upon any subcontractor under the CONTRACTOR to pay not less than the specified rates to all workmen employed by them in the execution of the WORK. BONDS: The successful bidder will be required to furnish DISTRICT with Payment and Performance Bonds equal to 100% of the Contract Price. Bonds shall be on the forms included in the Contract Documents; DISTRICT will not accept bonds on any other form. RETAINAGE FROM PAYMENTS: The CONTRACTOR may elect to receive 100 percent of payments due under the Contract Documents from time to time, without retention of any portion of the payment by the OWNER, by depositing securities of equivalent value with the OWNER in accordance with the provisions of Section 22300 of the Public Contract Code. Such securities, if deposited by the CONTRACTOR, shall be valued by the OWNER, whose decision on valuation of the securities shall be final. Securities eligible for investment under this provision shall be limited to those listed in Section 16430 of the Government Code, bank or savings and loan certificates of deposit, interest-bearing demand deposit accounts, standby letters of credit, or any other security mutually agreed to by the CONTRACTOR and the OWNER. OWNER'S RIGHTS RESERVED: The OWNER reserves the right to reject any or all bids, to waive any informality in a bid, and to make award, if any, to the lowest responsive, responsible bidder as it may best serve the interest of the OWNER.
