Description

Bids shall be for furnishing of all labor, materials and equipment as detailed on the contract documents dated February 2023. The major project items include: o Temporary traffic control o Temporary erosion control o Sanitary sewer main installation (open cut and bore/jack) o Sanitary sewer service installation (open cut and boring) o Asphalt pavement patching o Concrete pavement patching Each Bidder shall be appropriately licensed in the State of North Carolina as a Public Utilities Contractor as provided in General Statutes Chapter 87 and have the ability to produce evidence of experience in construction of projects of similar size and nature. Bidders must be able to comply with all local, state,and federal contract provisions as specified in the contract documents. The Owner's Engineer will also make the contract documents available for examination via email. However, only bids submitted on the Bid Form included in the Project Specifications purchased directly from the Engineer are considered acceptable. The Owner reserves the right to reject any and all Bids and any part of a Bid, and to waive formalities and technicalities in the Bids. The Bid shall remain subject to acceptance and not withdrawn for a period of ninety (90) days after the date of the bid opening. The City of Sanford is an equal opportunity employer and services provider. The City specifically encourages small, minority, and women owned businesses to submit bids. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, such bidder fails to satisfy the Owner that such bidder is properly qualified to carry out the obligations of the contract and to complete the work contemplated therein. Each bid must be accompanied by a certified check of the bidder or a bid bond prepared on the form of bid bond attached hereto, duly executed by the bidder as principal and having as surety thereon a surety company approved by the Owner, in the amount of five (5) percent of the aggregate amount of the price (base bid). Such checks or bid bonds will be returned to all except the three lowest bidders within three (3) calendar days after the opening of bids and the remaining checks or bid bonds will be returned promptly after the Owner and the accepted bidder have executed the contract, or, if no award has been made within ninety (90) calendar days after the date of the opening of bids, upon demand of the bidder at any time thereafter so long as he has not been notified of the acceptance of his bid. The successful bidder, upon his failure or refusal to execute and deliver the contract and bonds required within ten (10) calendar days after he has received the Notice of Award, shall forfeit to the Owner, as liquidated damages for such failure or refusal, the security deposited with his bid. Time of Completion and Liquidated Damages Bidder must agree to commence work on or before a date to be specified in a written "Notice to Proceed" of the Owner and to fully complete the project within 100 calendar days. Bidder must agree also to pay as liquidated damages the sum of $1,000.00 for each consecutive calendar day thereafter as hereinafter provided in the General Conditions.
