Bids received more than ninety-six (96) hours, excluding Saturdays, Sundays, and holidays, before the time set for opening of bids, as well as bids received after the final time set for receipt of bids, will not be considered and will be returned unopened. No Bidder may withdraw a bid within 90 days after the actual date of opening thereof. A Business Relationships Affidavit, Non-Collusion Affidavit, and a cashier's check, a certified check, or a surety bid bond, in the amount of five percent (5%) of the gross amount of bid as a guaranty, shall accompany the sealed proposal of each bidder. Deposits will be returned to the unsuccessful bidders and to successful bidders upon approval of the contract and submission of a 100% Performance Bond, a 100% Statutory Bond, and a 100% Maintenance Bond. On all bids below the amount of $50,000.00, the City of Enid reserves the right to waive any or all bond requirements.
