Description

Each bid shall be submitted electronically on website and must be accompanied by a certified check, cashier's check, or bid bond with an approved surety company as surety, payable to Los Angeles County Sanitation District No. 2 or other authorized security provided by Public Contract Code 20784, for an amount equal to at least ten percent of the amount bid as a guaranty that the bidder, if successful, will enter into a contract satisfactory to the Board of Directors for completing the work contemplated, and the original must be provided to the District by the time of electronic bid opening. The electronic bid shall include an electronic copy of a certified cashier's check, or electronic copy of the original bid bond, or the Bidder may provide a bid bond authorization code provided to them by Surety 2000, which the Bidder shall keep in effect until the District gives notice that it may be released. The successful bidder must file good and sufficient bonds for the faithful performance of the contract and for the payment of laborers and materialmen. Bonds for the faithful performance of the contract and for the payment of laborers and materialmen that are issued by sureties that are listed in the latest version of the U.S. Department of Treasury Circular 570 and that are authorized to issue bonds in the State of California, and whose bonding limitation shown in the circular is sufficient to provide bonds in the amount of the contract, will be deemed approved unless specifically rejected. Bonds issued by all other sureties are subject to approval by the Board of Directors and must be accompanied by all of the documents enumerated in California Code of Civil Procedure 995.660(a), as amended. At the time of bid, the Contractor shall possess a valid California Contractor's License in one of the following classifications: GENERAL ENGINEERING "A" or "C34", or "C42" At the request and expense of the Contractor, securities equivalent to the amount withheld from progress payments may be deposited with the District or with a state or federally chartered bank as the escrow agent, who shall, during the performance of the work, hold such instruments in the name of the District, and return such securities to the Contractor upon satisfactory completion of the contract. The option of placing funds in escrow is provided to Contractor pursuant to California Public Contract Code 22300; should that law cease to be effective, Contractor shall not have this option as to any progress payment paid or payable after the date the law ceases to be effective. Securities eligible for investment under this provision include those listed in 16430 of the Government Code or FDIC insured bank or savings and loan certificates of deposit. The Contractor shall be the beneficial owner of any security substituted for monies withheld and shall receive any interest thereon. Department of Industrial Relations Registration and Prevailing Wage Compliance: This project constitutes a "public work" within the meaning of the California Labor Code (the "Labor Code") section 1720 and is subject to the prevailing wage laws. Pursuant to Labor Code sections 1725.5 and 1771.1, all bidders must be registered with the California Department of Industrial Relations ("DIR") at the time of bidding, in order to enter into a contract, and to perform any work on the project. Pursuant to section 1771.4 of the Labor Code, the work on this project is subject to compliance monitoring and enforcement by the DIR. Pursuant to provisions of the Labor Code of the State of California, not less than the general prevailing rate of per diem wages and not less than the general prevailing rate of per diem wages for legal holiday and overtime work for each craft or type of workman needed to execute the work contemplated under the agreement, as ascertained by the Director of the Department of Industrial Relations, must be paid to all workers employed on the work by the Contractor or by any subcontractor doing or contracting to do any part of the work. In accordance with Labor Code section 1773.2, the District will have on file copies of the prevailing rates of per diem wages at its principal office and at each job site, which shall be made available to any interested party upon request. Alternatively, general prevailing wage rates may be obtained from the State of California Department of Industrial Relations, Director's Office of Policy, Research and Legislation, Prevailing Wage Unit, at (415) 7034774 or online at website In accordance with Labor Code Section 1773.2, the Contractor shall post a copy of the determination of prevailing rates of per diem wages at each job site. In accordance with Labor Code section 1777.1, any contractor or subcontractor that commits a willful violation or has an intent to defraud under Chapter 1 of Part 7 of Division 2 of the Labor Code (excluding section 1777.5) shall result in that contractor or subcontractor, and any entity in which that contractor or subcontractor has an interest, becoming ineligible to bid on or be awarded a contract for a public works project or perform work as a subcontractor on a public works project.
