Description

The District encourages participation in its construction contracting by all members of the community including Minority Business Enterprises (MBE), Women Business Enterprises WBE), Disadvantaged Business Enterprises (DBE), Disabled Veterans Business Enterprises (DVBE) and Small Business Enterprises (SBE). The District has established an aspirational goal of 20% overall participation by such firms. Although such participation is encouraged, award of a contract is not based on race, gender, disabled, disadvantaged or small business status. The work consists of rehabilitation of approximately 616 feet of existing 78-inch diameter reinforced concrete (RCP) sewer between Manholes A 0300 and H 0405 with fiberglass reinforced plastic (FRP) liner pipe on the San Jose Creek Water Reclamation Plant Influent Sewer and all appurtenant work. The Board of Directors may reject all bids. Unless all bids are rejected, award will be made to the low, responsive, responsible bidder. The work of construction must be completed within 100 WORKING DAYS after the date in the Notice to Proceed. Bidders on this work will be required to comply with the President s Executive Order No. 11246. Department of Industrial Relations Registration and Prevailing Wage Compliance: This project constitutes a "public work" within the meaning of the California Labor Code (the "Labor Code") section 1720 and is subject to the prevailing wage laws. Pursuant to Labor Code sections 1725.5 and 1771.1, all bidders must be registered with the California Department of Industrial Relations ("DIR") at the time of bidding, in order to enter into a contract, and to perform any work on the project. Pursuant to section 1771.4 of the Labor Code, the work on this project is subject to compliance monitoring and enforcement by the DIR. Pursuant to provisions of the Labor Code of the State of California, not less than the general prevailing rate of per diem wages and not less than the general prevailing rate of per diem wages for legal holiday and overtime work for each craft or type of workman needed to execute the work contemplated under the agreement, as ascertained by the Director of the Department of Industrial Relations, must be paid to all workers employed on the work by the Contractor or by any subcontractor doing or contracting to do any part of the work.
