On May 28, 2021, a Sheboygan County judge ruled against the DNR decision to issue the company wetland construction permits, a final decision is pending from the Court of Appeals. The project is also pending a decision from the Sheboygan County Circuit Court regarding the issuance of a stormwater permit. The Wisconsin Supreme Court has approved Sheboygan's annexation of the property. The project has obtained a ruling in its favor from the Wisconsin Supreme Court regarding a challenge made by The Friends of the Black River Forest regarding the transfer 6.5 acres of public land within Kohler-Andre State Park to the company for the project.
