Description | Plans call for a medical office building. The scope of work includes the building core & shell and all site development. As of July 22 2022, this project has yet to announce a selected general contractor. *The bid list for this project may be incomplete. Addendum #1-#4 have been issued as of 7-13-2022. RFI Responses Document has been issued as of 7-11-2022. Note from C.T. Wilson: Do not include sales tax on materials that remain part of the building after construction per the contract draft of AIA A101 section 3.6.2. This is typical on Duke Health projects. "§ 3.6 Taxes § 3.6.1 The Contractor shall pay sales, consumer, use and similar taxes for the Work provided by the Contractor that are legally enacted when bids are received or negotiations concluded, whether or not yet effective or merely scheduled to go into effect. § 3.6.2 The contract sum shall not include North Carolina Sales tax. Except as set forth in Subparagraph 3.6.5, the Contractor will be reimbursed for sales tax paid in addition to the Contract Sum. § 3.6.3 The Contractor shall list and provide a total of sales taxes paid during each month by County of North Carolina on a form to be furnished by the Owner. Such listings shall include sales taxes paid by the Contractor and its Subcontractors and shall be submitted along with each monthly request for payment. Each invoice submittal for tax reimbursement shall be limited to no more than 400 pages per each invoice submitted. Contractors can submit more than one invoice request in order to properly invoice for all eligible sales tax for any time period and comply with this request. For each tax receipt, Contractor shall indicate which pay application the work was invoiced. § 3.6.4 In those instances where a Contractor purchases materials from a Subcontractor and /or materials made for use in construction work for the Owner and pays sales or use tax on such materials, the Contractor shall report monthly the amount sales tax paid by any the firm names and amounts and enter on the sales tax form. § 3.6.5 Sales or use tax paid on purchase or rental of tools and equipment used by any prime contractor and/or Subcontractor shall be included in the Contract Sum and will not be reimbursable." |
