Description | ** As of March 7, 2023 this project has not yet been awarded. This project is expected to be awarded on March 7 at the Council Meeting. Last Day to Submit Written Questions: February 8, 2023 @ 5:00 PM The work to be done includes, but is not limited to the following: sawcut, cold-planning existing asphalt concrete, grading, compaction, hot mix asphalt concrete, minor concrete including demo, cross-gutter, spandrels, sidewalks, ADA Ramps, adjusting utility frame covers to grade, and other items of or details not mentioned above, that are required by typical construction, Standard Specifications or these special provisions. Bids must be submitted on the Bid Proposal form provided by the City of Wasco. Each bid must be accompanied by one of the following forms of bidder's security in the amount of ten percent (10%) of the amount bid: (1) cash; (2) a cashier's check made payable to the City of Wasco; (3) a certified check made payable to the City of Wasco; or (4) a bidder's bond executed by an admitted surety insurer, made payable to the City of Wasco. Each bidder must be a licensed contractor as required by law at the time the contract is awarded. The bidder who is awarded the project contract will be allowed pursuant to Public Contract Code Section 22300 to substitute securities for the payment of funds withheld under the contract. In addition, the successful bidder must furnish: (1) a faithful performance bond in the amount of one hundred percent (100%) of the contract price; and (2) a payment bond (also referred to as a labor and material bond) in the amount of one hundred percent (100%) of the contract price. All bonds must be in a form approved by the City of Wasco and must conform to California law (see Code of Civil Procedure section 995.010 et seq.). All documents submitted in compliance with the requirements of this bid package and the contract must be scannable and photocopiable. The City hereby invokes its protest right under California Code of Civil Procedure 995.660 for any proposed surety bond submitted in satisfaction of the requirements of this agreement if the submitted bond is not issued by an admitted surety rated A-, VII or better by Best's Rating Service. The contractor shall possess a City Business License and a Class "A" license at the time this contract is awarded. No contractor or subcontractor may be listed on a bid proposal or awarded a contract for a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code Sec. 1725.5. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990. A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of any contract for public work, as defined in this chapter, unless currently registered and qualified to perform public work pursuant to Section 1725.5 It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded. Inquiries or questions based on alleged patent ambiguity of the plans, specifications or estimate must be communicated as a bidder inquiry prior to bid opening.
