Description

**As of December 12, 2023 this project has not yet been awarded. A timeline for award has not yet been established.** This project consists of mechanical rehab ofCity ofOsage Beach lift stations,62-3 Lazy Days Rd., 24-1 Osage Beach Rd., and 54-3 Rockway. Station rehab includes demolition of existing pipe, valves, and other apparatus. New work includes installation ofnew pipe, pumps, fittings, valves, and fall thru prevention. Other work included with the project includes bypass pumping, site restoration, and other incidental items and work described in the Project Manual, or reasonably inferable therefrom. The prevailing hourly rate ofwages, as determined by the Federal Wage Determination and/orthe Industrial Commission ofMissouri, Annual Wage Order #29, including amendments, will be complied with on this project, and not less than the prevailing hourly rate ofwages as found by the agencies or Court ofAppeals shall be paid to all workmen performing work under this contract. No bidder may withdraw his bid within 60 days after the actual date ofthe opening thereof. Any Bidder or equipment supplier whose firm or affiliate is listed on the General Services Administration (GSA) publication entitled "Lists of Parties Excluded from Federal Procurement or Non-procurement Programs" will be prohibited from the bidding process. Anyone submitting a bid who is so listed will be determined to be a non-responsive Bidder in accordance with 40 CFR 31. Bidders on this work will be required to comply with the President's Executive Order No. 11246 in regard to non-discrimination in employment. Enrollment in Federal Work Authorization program Bidders are informed that pursuant to Section 285.530, RSMo, as a condition ofthe award of any contract in excess of five thousand dollars ($5,000.00), the successful bidder shall, by sworn affidavit and provision ofdocumentation, affirm its enrollment and participation in a federal work authorization program with respect to the employees working in connection to the contracted services. Successful bidders shall also sign an affidavit affirming that it does not knowingly employ any person who is an unauthorized alien in connection to the contracted services. Safety training Bidders are informed that the Project is subject to the requirements of Section 292.675, RSMo, which requires all contractors or subcontractors doing work on the Project to provide, and require its on-site employees to complete, a ten (10) hour course in construction safety and health approved by the Occupational Safety and Health Administration ("OSHA") or a similar program approved by the Missouri Department ofLabor and Industrial Relations which is at least as stringent as an approved OSHA program. The training must be completed within sixty (60) days ofthe date work on the Project commences. On-site employees found on the worksite without documentation ofthe required training shall have twenty (20) days to produce such documentation. Authorized employees Contractor acknowledges that Section 285.530 RSMo, prohibits any business entity or employer from knowingly employing, hiring for employment, or continuing to employ an unauthorized alien to perform work within the state of Missouri. Contractortherefore covenants that it is not knowingly in violation ofsubsection 1 ofSection 285.530 RSMo, and that it will not knowingly employ, hire for employment, or continue to employ any unauthorized aliens to perform work on the Project, and that its employees are lawfully eligible to work in the United States. The City reserves the right to reject any and all bids, to waive informalities or irregularities, and to determine the lowest responsive and responsible bidder, and to award the contract on that basis. All Bidders must agree that such rejection shall be without liability on the part of the City for any damage or claim brought by any Bidder because of such rejection, nor shall the Bidder seek any recourse ofany kind against the City because ofsuch rejection. The filing ofany Bid in response to this invitation shall constitute an agreement ofthe Bidder to these conditions. All disputes under this contract and any litigation resulting under this contract shall be filed, tried, remain and be ultimately resolved in the Circuit Court ofCamden or Miller County on any appeal therefrom within the courts ofthe State ofMissouri. The contractor hereby knowingly, intelligently and voluntarily agrees and waives any and all removal rights to federal court or the right to litigate the claim or any part thereof in courts of any other state for any reason
