Description

Bowden Academy 2020 Bond Project Renovations Questions Due Date: Aug 16th 2022, 12:00 PM Beginning of Construction is anticipated to be from the date of the Notice to Proceed which shall not be later than 90 days after the proposal opening. All work will be during regular business hours (7:00 AM to 3:30 PM). Work should be allowed after hours and during weekends if all possible. The Offeror agrees to have the project (including any accepted alternates) substantially complete by July 28th, 2023. Each proposal must be accompanied by a Proposal Security (Bid Bond) on a form substantially similar to AIA Document A310 (1970 Edition) or on a form otherwise acceptable to the Owner, in the amount of five percent of the largest possible total proposal or proposals, including consideration of alternates, which sum shall be paid to Owner as liquidated damages in the event that the Offeror, if awarded the Contract, should fail within ten (10) calendar days after the date of the Notice of Award to execute and return the Contract, together with the Performance and Payment Bonds with acceptable surety. In lieu of a Bid Bond, as Proposal Security, Owner may accept a deposit of the amount of five percent of the largest possible proposal or proposals, including consideration for alternates, by cashier's check issued by a bank satisfactory to Owner. The Owner shall have the right to retain the security of all offerors to whom an award is being considered until either (i) the Contract has been executed and delivered by all parties and any required payment and performance bonds, evidence of insurance, and other submittals have been furnished, or (ii) all proposals have been rejected by the Owner. The District reserves the right to automatically revoke Board Award if the successful Offeror does not provide an original Certificate of Insurance with Performance and Payment Bonds in an amount of one hundred percent of the largest possible total proposal or proposal within ten (10) working days from Board Award Date. The undersigned agrees that the amount posted by the Proposal Surety, which will be five percent (5%) of the maximum contract price of the above proposal, will be received and retained by Owner as liquidated damages in the event that undersigned Offeror should fail, if awarded the Contract, within ten (10) calendar days after date of Notice of Award to execute and return the Agreement, together with the Performance and Payment Bonds and Insurance Certificates as indicated. The undersigned Offeror agrees that the amounts secured by the Proposal Surety are the proper measure of liquidated damages that Owner will sustain upon Offeror's failure as described above, and that these sums under no circumstances represent a penalty. If the San Antonio Independent School District determines that a worker has been underpaid or not paid in accordance with the provisions hereof, if the worker cannot be located by the contractor or the San Antonio Independent School District after diligent efforts to accomplish same, such unpaid or underpaid wages shall be reserved by the San Antonio Independent School District in a special "missing workers account established by the San Antonio Independent School District for such employees. If, after one year from the final acceptance of the project by the District, a worker still cannot be located, in order that the San Antonio Independent School District may make effective interim reuse of the money, such wages and any associated liquidated damages may be used to defray actual costs incurred by the San Antonio Independent School District in attempting to locate said worker; and any remaining monies may then revert back to the San Antonio Independent School District's original funding source for the project.
