Description

Work includes but is not limited to the installation of five (5) new rotating biological contactors (RBCs) within the Hamilton Township Water Pollution Control Facility RBC Building, including all demolition, mechanical, electrical and other associated work as shown and specified on the Contract Documents. All work shall be completed at the Hamilton Township Water Pollution Control Facility located at 300 Hobson Avenue, Hamilton, New Jersey Checks must be made payable to the Township of Hamilton. Bids shall be submitted on the form(s) provided and shall be in accordance with the specifications contained in the Instructions to Bidders and other bidding documents. Bidders are required to comply with the requirements of the Local Public Contracts Law; the Prevailing Wage Act, N.J.S.A. 34:11-56.25 et seq.; the requirements of P. L. 1975, c.127, and N.J.S.A. 10:5-31 et seq. and N.JA.C. 17:27-1.1 et seq., Affirmative Action; and all requirements as set forth in the Instructions to Bidders. Bids must be made on standard proposal forms, in the manner designated and must be received in sealed opaque envelopes, bearing the name and address of the bidder and the name of the project on the outside, addressed to the Purchasing Agent, Township of Hamilton and must be accompanied by a Non-Collusion Affidavit, as per N.J.S.A. 52:34-15 and a bid bond or certified check for not less than ten percent (10%) of the amount of the bid, providing that said check or bid bond need not be more than $20,000.00 nor shall be less than $500.00, as per N.J.S.A. 40A:11-21, and be delivered at the place and on or before the hour named above. The Township may reject any or all bids, as per N.J.S.A. 40A:11-13.2. A bidder may request that its bid be withdrawn due to a "mistake" on the part of the bidder, as defined in N.J.S.A. 40A:11-23.3. Otherwise, no bids may be withdrawn for a period of sixty (60) days after the date and time set for the opening of the bids Also, under N.J.S.A. 34:11-56.48 et seq. and N.J.S.A. 34:11-56.55, the Contractor and all subcontractors must be registered pursuant to the Public Works Registration Act. It is recommended that a copy of the Contractor's and Subcontractor's current Certificate of Registration is submitted with the bid proposal as well as the Business Registration Certificate issued by the State of New Jersey. If copies are not provided with the bid submittal the copies must be provided prior to contract award. All Bid Addenda will be issued on the Township and all interested bidders will receive addenda by fax or certified mail. All interested respondents should still check the website from now through bid opening. It is the sole responsibility of the respondent to be knowledgeable of all addenda related to this procurement. This project is funded in part by the New Jersey Environmental Infrastructure Financing Programs, and the successful bidder must comply with the provisions of N.J.A.C. 7:22-9 et seq. for the participation of small business enterprises owned and controlled by socially and economically disadvantaged (SED) individuals. A goal of ten (10) percent for SED participation has been set for this project. The invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization requirements. This contract or subcontract will be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3,4,5, 9 and 10. In accordance with the provisions of N.J.S.A. 58:11B-26 and N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9. In accordance with the provisions at N.J.A.C. 7:22-3.17(g), all applicable surety bonds required in connection with the advertisement and award of building contracts or sub agreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570Surety Companies Acceptable on Federal Bonds), incorporated herein by reference. Copies of this document may be obtained from the Department. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27. The Owner reserves the right to reject all Bids pursuant to N.J.S.A. 40A:1113.2 and N.J.A.C. 7:22-9.10(a). Please be advised that prior to contract award, the successful bidder shall be required to provide certification that they are not engaged in prohibited activities in Russia or Belarus pursuant to P.L. 2022, c.3
