**As of April 10, 2023, project was awarded to Hulstein Excavating but awarded amount is not available.** Invitation to Bid Julian Parking Lot #23 UNIVERSITY OF SOUTH DAKOTA Notice is hereby given that sealed combined BIDS will be received by the University of South Dakota, Purchasing Office (herein called the OWNER) at: USD Purchasing Office, 209 Slagle Hall, 414 East Clark St., Vermillion, SD 57069, until , February 21, 2023 at 2:00 p.m. CST, and then at said office publicly opened and read aloud for labor and materials to perform Julian Parking Lot #23, at the University of South Dakota Vermillion, South Dakota. There will be an on-site pre-bid meeting on February 9, 2023 at 1:00 PM at the Service Center, Conference room 111, at the south entrance. This pre-bid meeting is optional but is the bidders only opportunity to review the site. Bidders are responsible to know site conditions prior to submitting bids. In consideration of the University of South Dakota providing such plans and specifications for the purpose of preparing a bid, bidder further agrees: A. The plans and specifications are the sole property of the University; B. Any copies of the plans and specifications obtained directly from the University will be returned to the University immediately after the University provides notice that bidder will not be awarded a contract, or thirty (30) days after the bid opening for the project, whichever occurs first; C. Any copies of the plans and specifications made by the bidder will be destroyed immediately after the University provides notice that bidder will not be awarded a contract, or thirty (30) days after the bid opening for the project, whichever occurs first; D. If bidder does not submit a bid, bidder will fulfill the requirements of B and C above on or before the date of the bid opening; E. The plans and specifications are to be used only with respect to this project and are not to be used for any other project or purposes other than preparing a bid for this project; F. The plans and specifications will not be disseminated to any person or entity for purposes other than obtaining pricing information without the express written approval of the state; G. All information contained in the plans and specifications is confidential; and H. Should the bidder disseminate the plans and specifications to an individual or entity for purposes of obtaining pricing information, the bidder will require that individual or entity to adhere to the terms set forth herein. The bidder, however, assumes no liability for the misuse of the plans and specifications by such third party or such third party's failure to comply with the provisions contained herein. I. Should bidder be awarded a contract for construction of the project, bidder does not need to return or destroy plans and specifications until after completion of the project. Bids shall be submitted on the bid forms supplied in the project manual. No oral, facsimile or telephone bids will be accepted. Each BID must be submitted, addressed to Purchasing Office at: Purchasing Office, the University of South Dakota, 209 Slagle Hall, 414 East Clark St., Vermillion, SD 57069. Each BID must be plainly marked on the outside as BID for the Julian Parking Lot #23 University of South Dakota, and the envelope should bear on the outside the name of the BIDDER, his address, and his license number if applicable. The OWNER may waive any irregularities, informalities or minor defects or reject any and all BIDS. Any BID may be withdrawn prior to the above scheduled time for the opening of BIDS or authorized postponed thereof. Any BID received after the time and date specified shall not be considered and will be returned unopened. No BIDDER may withdraw a BID within 30 days after the actual date of the opening thereof. Should there be reasons why the contract cannot be awarded within the specified period; the time may be extended by mutual agreement between the OWNER and the BIDDER. Each BID in excess of $50,000 must be accompanied by a BID BOND issued by a surety company authorized to do business in the State of South Dakota payable to the OWNER for ten percent of the total amount of the BID. As soon as the BID prices have been compared, the OWNER will return the BONDS of all except the three lowest responsible BIDDERS. When the Contract is awarded, the BONDS of the two remaining unsuccessful BIDDERS will be returned. The BID BOND of the successful BIDDER will be retained until the payment BOND and the performance BOND have been executed and approved, after which it will be returned. A certified or cashier's check issued by a State or National bank in the amount of five percent of the total bid may be used in lieu of a BID BOND.
