Description

No bid will be considered which is not accompanied by a certified or cashier's check or bid bond in the amount of five percent (5%) of the total bid price, payable to "City of Methuen". These bid deposits will be returned within ten (10) days after the bid opening to all but the three low bidders, whose deposits will be returned upon execution of the contract. If the successful bidder fails to execute the contract, his bid deposit will become the property of the City of Methuen. No proposal may be withdrawn within thirty (30) days, Saturdays, Sundays and legal holidays excluded, after the opening of bids. In accordance with Section 34 of Chapter 90, prospective bidders for Items 1, 4, and 5 must be prequalified in accordance with 720 CMR 5.00, "Prequalification of Contractors". Only bidders listed in the official or waiver contractor lists issued by MassDOT Prequalification Office may obtain an official proposal sheet. Pursuant to M.G.L. c.30, 39S, any person submitting a bid for, or signing a contract to work on, a public works project estimated to cost more than $10,000, must certify under the pains and penalties of perjury that he or she is able to furnish labor in harmony with all other elements of labor employed in the work and that all employees employed on the worksite, or in work subject to the bid, have successfully completed at least ten hours of OSHA approved training. Under the provisions of the Massachusetts General Laws, Chapter 149, Section 26-27G inclusive, as amended, the successful bidder for Items 1 through 5 must pay his workers the minimum wage rates as established by the Commissioner of Labor and Industries. The Awarding Authority reserves the right to reject any or all bids and to waive any informalities in the bidding if it is deemed to be in the interest of the City to do so.
