Description | The scope of the work includes the curbside removal and disposal of all garbage, trash and recyclable materials which shall be made and accumulated in dwelling houses, hotels, stores, commercial establishments, apartments, condominium units, houses of worship, Housing Authority facilities, and other buildings or premises in the City of Elizabeth as described in the specifications and Contract Documents. All private and public schools, municipal buildings, and Board of Education buildings are also part of this contract. Proposals shall be made for the following periods: Proposal Period #1, From January 1, 2023 to December 31, 2023 (1-year contract) Proposal Period #2, From January 1, 2023 to December 31, 2024 (2-year contract) Proposal Period #3, From January 1, 2023 to December 31, 2025 (3-year contract) Proposal Period #4, From January 1, 2023 to December 31, 2026 (4-year contract) Proposal Period #5, From January 1, 2023 to December 31, 2027 (5-year contract) Bidders must provide pricing for all Proposal Periods. Prospective bidders will be required to meet all the conditions as set forth in the specifications and specimen contract. All bidders shall be required to submit their bid on the bid sheet forms furnished by the Department of Public Works, which bid form shall reflect a breakdown of the cost of the services. The successful bidder will be required to comply with all New Jersey laws governing the execution of municipal contracts. Each bid must be accompanied by a cashiers check or certified check, payable to the City of Elizabeth and issued by a recognized bank or trust company, or by a Bid Bond equal to that attached to the proposal, duly executed by the bidder as principal and having as surety thereon a surety company approved by the City of Elizabeth in an amount not less than ten percent (10%) of the amount of the bid, but in no case in excess of $20,000.00. The City of Elizabeth intends to make award of the contract within 60 days of the bid opening. However, if for any reason the City of Elizabeth is unable to make an award within such 60-day period, the City of Elizabeth and each of the apparent lowest responsible bidders and their proposed sureties may agree on an extension of time for making of the award in accordance with N.J.S.A. 40A: 11-24. The award or rejection of a contract of the within project is subject to the time limitations set forth in N.J.A.C. 7:26H-6.7, except that the bids of any bidders who consent thereto may, at the request of the contracting unit, be held for consideration for such longer period as may be agreed. A bidder to whom a contract is awarded shall furnish a Performance Bond from a surety company duly licensed and authorized to do business in the State of New Jersey, in the amount required by the Bid Specifications conditioned upon the faithful performance by the Contractor of the terms of the contract which are and shall be a part of the specifications and proposal. The City Council may select any of the proposal periods and/or reject any or all bids or any part thereof, in accordance with applicable law and N.J.A.C. 7:26H-6.5(h). The City Council also reserves the right to award to the bidder whose aggregate bid price for the selected Proposal Period is the lowest responsible bid proposal period, From January 1, 2023 to December 31, 2023 (1-year contract), From January 1, 2023 to December 31, 2024 (2-year contract), From January 1, 2023 to December 31, 2025 (3-year contract), From January 1, 2023 to December 31, 2026 (4-year contract), or From January 1, 2023 to December 31, 2027 (5-year contract). The City Council reserves the right to give notice of termination of this contract at any time if it shall be determined that the City will provide for its own collection service through City owned equipment and by City personnel on six (6) months notice in writing issued by the City to the Contractor, and in the event of any delay in operation after the period of said six (6) months notice, payment for the services of the Contractor shall be established on a per diem basis by calculating the cost per day based on the total year cost divided by the number of collections per year. Attention of bidders is particularly called to the requirements as to conditions of this contract to be observed and minimum wage rates to paid under the contract. Each prospective bidder will be required to comply with N.J.S.A. 10: 5-1, et seq., as amended by P.L. 1975, C.127 (N.J.A.C. 17:27) regarding nondiscrimination employment. Attention of bidders is particularly called to the requirements of N.J.A.C. 7:27-32, the Diesel Retrofit Program (DRP) regulations. The successful bidder shall at all times remain in compliance with N.J.A.C. 7:27-32 et seq. Non-compliance at any time with said Program shall be deemed a breach of the Contract. In case of non-compliance, the successful bidder may be served by the City with notice to cure. If within 30 days of service, the successful bidder remains in non-compliance with the Diesel Retrofit Program, said bidder may be served with notice of cancellation of the Contract by the City of Elizabeth. Attention of bidders is particularly called to the requirements of Chapter 2.92 (formerly Chapter 65) of the City of Elizabeth as supplemented and amended which requires the submission of certain affidavits (see section 7.2.3) which shall be considered by the City, in its determination of the responsibility of the lowest bidder. The City specifically reserves the right to waive minor bidding irregularities with regard to the bidding requirements and as determined by City Council to be immaterial.
