Description | The general nature of the work is described in general as site preparation and construction of a new outpost facility including office space and garage bays. Construction items include civil, architectural, structural, mechanical, electrical and plumbing work. Bid security shall be submitted with each bid in the amount of 5 percent of the bid amount in the form of a certified check or bid bond, made payable to NIPCO. The bid security becomes the property of NIPCO in the event the successful bidder fails to enter into a contract and post satisfactory performance and payment bonds. NIPCO reserves the right to defer acceptance of any proposal for a period not to exceed thirty (30) days after the date proposals are received and no proposal may be withdrawn during this period. NIPCO also reserves the right to reject any or all proposals and enter into such contract as it shall deem to be in the best interest of NIPCO. Owner reserves the right to reject any and all bids and to waive informalities and irregularities. Successful bidder shall begin the Work on receipt of the Notice to Proceed and shall complete the Work within the Contract Time.Substantial Completion of the Work shall be no later than November 30, 2023. Work is subject to liquidated damages. Contractor and Owner recognize that time is of the essence and that Owner will suffer financial and other losses if the Work is not completed and Milestones not achieved within the times specified, plus any extensions thereof allowed in accordance with the Contract. The parties also recognize the delays, expense, and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty): Substantial Completion: Contractor shall pay Owner $500 for each day that expires after the time (as duly adjusted pursuant to the Contract) for Substantial Completion until the Work is substantially complete. Completion of Remaining Work: After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the Contract Time (as duly adjusted pursuant to the Contract) for completion and readiness for final payment, Contractor shall pay Owner $500 for each day that expires after such time until the Work is completed and ready for final payment. Liquidated damages for failing to timely attain Substantial Completion and final completion are not additive and will not be imposed concurrently. Bidders must be properly licensed under the laws governing their respective trades and be able to obtain insurance and bonds required for the Work. A Performance Bond, separate Labor and Material Payment Bond, and Insurance in a form acceptable to Owner will be required of the successful Bidder. |
