Description

The project consists of a low pressure sewer system to an existing subdivision that is not currently served with a sanitary sewer utility. The project includes the installation of 85 individual property grinder stations and associated electrical connections to the existing properties. The low pressure sewer system installation includes approximately 8,300 lineal feet of small diameter force main to be installed via trenched and directionally drilled methods, and approximately 12,000 lineal feet of 1.25 inch low pressure sewer service line to be installed via trenched and directionally drilled methods. The project also includes the installation of approximately 3,000 feet of 12-inch diameter gravity sewer and associated manholes. Additionally, the project includes boring a 6-inch steel casing to be installed under a State Highway. Various site work associated with the improvements includes HMA pavement, erosion controls, seeding, granular surfacing, traffic control, etc. The City Council will accept and consider the Bids received at their meeting at 6:00 p.m. local time on August 1, 2022 at City Hall, 261 Sinsinawa Avenue, East Dubuque, Illinois. . Each bidder shall accompany its bid with bid security in the form of a bid bond, bank draft, cashier's check, or certified check payable to the City of East Dubuque for 5% of the total amount of the bid. Bids will be held for 90 days after the date of bid opening for Illinois EPA review and approval of award. Work on the improvement shall commence on or before the date specified in the written Notice to Proceed and the contracts shall be completed on or before September 29, 2023. Liquidated damages in the amount of $1,000.00 will be assessed for each day that the work shall remain uncompleted after the end of the completion date, with due allowance for extension of contract period due to conditions beyond the control of the Contractor, as approved by the Owner . . Warranty Period: The improvements shall be kept and maintained in good repair for a period of two years after substantial completion is determined by the Engineer. Any contracts awarded under this invitation for bids are expected to be funded in part by a loan from the Illinois Environmental Protection Agency (Illinois EPA). Neither the State of Illinois nor any of its departments, agencies, or employees is or will be a party to this invitation for bids or any resulting contract. The procurement will be subject to regulations contained in the Procedures for Issuing Loans from the Public Water Supply Loan Program (35IAC Part 662), the Employment of Illinois Workers on Public Works Act (30 ILCS 570), and the "Use of American Iron and Steel" requirements as contained in Section 436 of H.R. 3547, The Consolidated Appropriations Act, 2014. This procurement is also subject to the loan recipient's policy regarding the increased use of disadvantaged business enterprises. The loan recipient's policy requires all bidders to undertake specified affirmative efforts at least sixteen (16) days prior to bid opening. The policy is contained in the specifications. Bidders are also required to comply with the President's Executive Order No. 11246, as amended. The requirements for bidders and contractors under this order are explained in 41 CFR 60-4. The contractors shall pay prevailing wages in accordance with State of Illinois wage provisions. Attention is called to the fact that not less than the minimum salaries and wages as set forth in the contract documents must be paid on the project, and that the contractors must ensure that employees and applicants or employment are not discriminated against because of race, color, religion, sex or national origin. Contractors must comply with the Drug Free Workplace Act (Source: P.A. 86-1459). BIDDERS will comply with Sec. 436 of H.R. 3547, "The Consolidated Appropriations Act, 2014", which specifies that all iron and steel products used in the project are produced in the United States. All contractors and subcontractors that work within the State of Illinois right-of-way are required to be prequalified with the IDOT. As issued by the Illinois Department of Labor, due to the high unemployment rate caused by the ongoing COVID-19 pandemic, the Employment of Illinois Workers on Public Works Act was put into effect as of July 1, 2020. The state law requires the workforce on all public works projects to be comprised of a minimum of 90% Illinois residents. This Act is not currently in effect but if at any time during the project the unemployment rate goes above 5% statewide for two consecutive months, this Act will again be applicable. In an effort to comply with Disadvantaged Business Utilization and Affirmative Efforts, all bidders are required to advertise DBE subcontracting opportunities and to negotiate with disadvantaged businesses prior to bid opening. Failure to document such affirmative efforts shall be deemed, relative to disadvantaged business compliance, non-responsive. The advertisement must run one day at least 16 days prior to the bid opening. The advertisement requirements are included in the Illinois EPA Guidelines in Division 1 of the specifications. The bid totals will be available at and after the public bid opening. However, an itemized bid tabulation, if applicable, will not be publicly available until after the Owner awards the contract and funding agency award concurrence is obtained. The City of East Dubuque reserves the right to reject any or all Bids or to waive any informalities in the bidding. This invitation is given and published pursuant to authorization and direction of the City of East Dubuque.
