HVAC Upgrades at Alief Ninth Grade Center

Alief Independent School District ("AISD," "District," "Owner) is seeking Competitive Sealed Proposals from qualified proposers to provide construction services for a construction project located at the ALIEF NINTH GRADE CENTER, 6750 COOK ROAD, HOUSTON, TEXAS, 77072. The project scope of work consists of the replacement of existing HVAC and electrical equipment in the central plant of the Alief Ninth Grade Center, including but not limited to demolition and replacement of HVAC equipment, including chillers, cooling towers, boilers, water heaters, electrical switch board and panels, pumps, piping, and building management controls. The estimated budget for this project is $2,000,000. This procurement, any award under this procurement, and the resulting contract, if any, is subject to approval by the AISD Board. Subsequent to required approval, the only person authorized to commit AISD contractually is the Superintendent or his designee. This solicitation is an invitation for sealed proposals and neither this solicitation nor the response or the proposal from any prospective proposer/contractor shall create a contractual relationship that would bind AISD until such time as both AISD and the selected proposer/contractor sign a legally binding contract, which includes, without limitation, the terms required by AISD. Proposals that have been opened may not be changed for the purpose of correcting an error in the price. Other than price, a proposer may have the right to change any other error or mistake in the proposal as may be permitted by applicable law and subject to the approval of AISD, unless such change would be in contravention of statutory or common law requirements or unless such change would give an unfair advantage to the proposer making such change. Contract Term: Actual work to be performed and the schedule for performance under this solicitation will be upon the terms, conditions, and timelines agreed upon by AISD and the selected contractor. Time is of the essence for this project. All Work listed in the construction documents shall be substantially completed no later than Saturday, August 3, 2024, the estimated project completion date. Final completion shall be completed no later than 90 calendar days following substantial completion. Question Cutoff Date: 1/9/2024 02:00 PM (CT) Proposal security shall be submitted with each proposal in the percentages of the Base Proposal amount detailed below. Proposal security consisting of a certified check, cashier's check or bid bond in the amount below shall accompany the proposal response: 1. five percent (5%) for projects with construction budgets up to $500,000, or 2. ten percent (10%) for projects with construction budgets over $500,000. Security shall be made payable to the Alief Independent School District. The security will be retained until the Contract is signed and the required bonds have been furnished. If any contractor refuses to enter into a contract within thirty (30) days, Alief ISD will retain the security as liquidated damages, but not as a penalty. Proposal security will be returned to all bidders upon receipt of the Performance and Payment bonds presented by the awarded contractor.
