Description

**As of July 17, 2023, bid received was rejected because it was incomplete, non-conforming and non-responsive bid. Project will rebid but no definite date yet.** BCUA-C-22-001 Bergen County Utilities Authority ERB Black Start Project The Black Start Project generally consists of the construction of upgrades and improvements to the Co-generation facility, switch gear, and related equipment Bidder shall submit with the bid an electronic bid bond or electronic copy of a bid bond in the amount of ten percent (10%) of the total price bid, but not in excess of $20,000.00, payable unconditionally to the Bergen County Utilities Authority, along with a Certificate (Consent of Surety) with Power of Attorney for the full amount of the bid price from a Surety Company authorized to do business in the State of New Jersey and said Surety will furnish a consolidated Performance and Payment Bond in amounts of 100% of the successful Bidder's contract. if the Bidder is to submit a certified check or cashier check: (1) the bidder shall include an image of the check upon submitted their bids through the electronic platform in accordance with NJAC 5:34-5.3(f)(1); and (2) the physical check shall be sealed upon submission to the Authority and clearly marked as part of the bidders response in accordance with NJAC 5:34-5.3(f)(2).at the following address; the Division of Purchasing no later than the time stated above at Foot of Merhrof Road, P.O. Box 9 Little Ferry, NJ 07643 -ALL OTHER DOCUMENTS MUST BE SUBMITTED ELECTRONICALLY CONDITIONAL BONDS SHALL BE REJECTED In accordance with N.J.A.C. 5:34-5.3(e), and addenda will be transmitted to the Bidders through the Bonfire E-Procurement platform in lieu of the method of delivery otherwise required under New Jersey law including N.J.S.A. 40A:11-23. Bidders shall comply with the requirements of N.J.S.A 10:5-31 and N.J.A.C. 17-27 et seq. Bidders shall comply with the "Prevailing Wage Act" N.J.S.A. 34:11-56.25 et se. and the Federal Davis Bacon Act. The Contractor shall pay the higher of the State or Federal wage rates. This Contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Infrastructure Bank and the NJ Economic Development Authority. Neither the State of New Jersey, the New Jersey Infrastructure Bank nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10 [N.J.A.C.7:22-3.17(d)]. The Contractor (subcontractor) shall comply with the provisions of N.J.S.A. 10:5-2.1 et seq., N.J.S.A. 58:11B-26, N.J.A.C. 17:27 et seq. and N.J.A.C. 7:22-3.17(a)24, and 4.17(a)24 and for the participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SED). These regulations regulations require that no less than 10 percent of the total amount of all contracts related to the project shall be awarded to SEDs. Successful bidder shall comply with SED Utilization Plan prepared by the OWNER. [N.J.A.C. 7:22-3.17(f)] In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4:17(a)24, the contractor (subcontractor) shall comply with all the provisions of N.J.A.C. 7:22-9. Bidders shall be required to comply with (a) the conditions of employment and requirements of Federal prevailing wage rates to be paid under the contract; (b) Section 3 of the HUD Act of 1968; (c) Prohibition of Segregated Facilities; (d) Section 109; and (e) E.O. 11246 The BCUA will not provide PPE. Bidders shall comply with the requirements of N.J.S.A 10:5-31 and N.J.A.C. 17-27 et seq., and Bidders are required to comply with the requirements of P.L.1975, c. 127. regarding affirmative action.
