CONSENT OF SURETY: Certificate from a Surety Company is required indicating consent to be bound as surety and guarantor for performance required under the Contract Documents. BID SUBMISSION PROCEDURES: Bids must be submitted on the Bid Form contained in the Contract Documents and must be enclosed in a sealed envelope plainly marked on the outside with the name of project and the name and address of the Bidder. The Bid must be delivered to the Owner prior to Bid opening at the above address for submitting Bids. Bids will not be accepted after September 26, 2023, 10:00 am CONTRACTOR REGISTRATION: Bidders are required is to submit a certificate from the New Jersey Department of Labor establishing that the bidder is registered pursuant to the Public Works Contractor Registration Act (P.L. 1999, c.238) Bidder are also required to submit current proof of Business Registration and current proof of Business Registration for all named Subcontractors in accordance with P.L. 2007 c.57. PUBLIC BID OPENING AND READING: Date: September 26, 2023 Time: 10:00 am Place: Borough of Wenonah, Wenonah Municipal Bldg, 1 Southwest Avenue, Wenonah, NJ 08090 STATUTORY REQUIREMENTS: Bidders are required to comply with applicable statutory requirements set forth in the Contract Documents including the New Jersey Public Contracts Law, NJSA 40A:11-1, the requirements of P.L. 1975, c. 127(NJAC 17:27) (Affirmative Action) and of P.L. 1963, c. 150 (Prevailing Wage) and Americans with Disabilities Act of 1990 (42 U.S.C. 12101, et seq.). The Bidder is further notified that he must comply with P.L. 1977,c.33, and submit a Disclosure Statement listing stockholders with his bid. DAVIS BACON WORK REQUIREMENTS: This project is subject to meet Federal Labor Standards Provisions Davis Bacon wage laws as explained in HUD form 4010. All work performed on the project will be subject to the approved wage determination rates in bid documents. SECTION 3 PREFERENCE: The work to be performed under this contract is subject to the requirements of section 3 of the Housing and Urban Development Act of 1968, 12 U.S.C. 1701 U (section 3). The purpose of section 3 is to ensure that employment and other economic opportunities generated by HUD assistance shall to the greatest extent feasible, be directed to low-and very low income persons. Section 3 businesses are encouraged to submit bid proposals. REJECTION OF BIDS: The Borough of Wenonah reserves the right to consider the bids for sixty (60) days after their receipt and further reserves the right to reject any or all Bids, in whole or in part, as permitted by law. The Borough of Wenonah also reserves the right to waive any Bid defect where such defect is not detrimental to the best interest of The Borough of Wenonah and fairness of the bidding process. The right is also reserved to increase or decrease the quantities specified in the manner designated in the Contract Documents. AWARD OF CONTRACT: The Award of Contract shall be made subject to the necessary monies to perform the work being provided by The Borough of Wenonah in a lawful manner. The Contract to be executed by the successful bidder will provide that it shall not become effective until the necessary monies to perform the work have been provided by The Borough of Wenonah in a lawful manner. The Award shall further be subject to the securing of the necessary State, Federal, and Local Permits governing the work.
