Description | CLARIFICATION DEADLINE 3/16/2023 11:00 AM The Borough of South Williamsport (Owner) is requesting Bids for the construction of the following Project: 2023 Curb Cuts & ADA Ramp Reconstruction Project, Contract 2023-01: General Construction The Project includes the following Work: Select ADA ramp reconstruction on West Central Avenue between Clark Street and South Market Street (SR 15 S.B.) and on Reynolds Street, Thompson Street, and Kane Street between West Central Avenue and West 8th Avenue. Bids are requested for Contract 2023-01: General Construction Bid security in the form of a Certified Check or Bid Bond and an acceptable Surety payable to the Borough of South Williamsport shall be furnished with the bid in an amount not less than 10% of the total bid. Bidders must comply with all State antibid-rigging regulations pertaining to work associated with this project, and will be required to submit an executed non-collusion affidavit with the bid. Bidders should refer to provisions of federal and state statutes, rules and regulations dealing with the prevention of environmental pollution and preservation of public natural resources that affect the project, pursuant to Act No. 247 of the General Assembly of the Commonwealth of Pennsylvania, approved October 26, 1972. This Project falls under The Commonwealth of Pennsylvania enacted Act 127 of 2012, known as the Public Works Employment Verification Act ('the Act') which requires all public work contractors and subcontractors to utilize the Federal Government's E-Verify system to ensure that all employees performing work on public work projects are authorized to work in the United States. All Bidders are required to submit a Public Works Employment Verification Form as a precondition for the Contract Award. In addition to the Equal Employment requirements of Executive Order 11246 regarding discrimination, the Contractor must establish a 6.9% goal for female participation and 1% goal for minority participation in his/her aggregate on-site construction workforce for contracts in excess of $10,000. The Borough of South Williamsport is utilizing federal funds for this project, and Lycoming County has adopted a Minority and Women Business Enterprise (MBE/WBE) in accordance with Executive Orders 11625, 12138, and 12432 and a Section 3 Action Plan in accordance with Title 24 Part 75 Code of Federal Regulations. As such, the bidders/offerors must submit documentary evidence of minority and women business enterprises and Section 3 business concerns who have been contacted and to whom commitments have been made. Documentation of such solicitations and commitments shall be submitted with the bid. Moreover, the Contractor shall strive to meet the MBE goal of 5% and the WBE goal of 3% for contracts of $25,000 or more. For projects which the amount of HUD or CDBG funding exceeds $200,000 the Contractor must attempt to meet the minimum numerical goals of which 25% or more of the total number of labor hours worked by all workers on a Section 3 project are Section 3 workers, per 24 CFR Part 75.19; and 5% or more of the total number of labor hours worked by all workers on a Section 3 project are Targeted Section 3 workers, as defined in 24 CFR Part 75.21.. Lycoming County, in accordance with its Section 3 Action Plan, may provide a bid performance to a bidder who is a Section 3 business concern. MBE/WBE and Section 3 business concerns shall be afforded full opportunity to bid without discrimination. Davis-Bacon and Related Acts apply to this Project. The funding for this Project does not exceed the $200,000 threshold; therefore, Section 3 solicitation requirements are not mandatory. All bids shall be irrevocable for 60 days after the bid opening date unless award is delayed by a required approval of another government agency, the sale of bonds, or the award of a grant or grants, in which case this Bid shall remain subject to acceptance for 120 days after the bid opening date as provided by the Act of November 26, 1978 (P.L. 1309, No. 317), as amended by the Act of December 12, 1994 (P.L. 1042, No. 142). The Borough of South Williamsportreserves the right to reject any and all bids, waive any defects, errors, omissions, mistakes, informalities, to accept any bid or combination of bids that are deemed to be in the best interest of the Borough, and to reject any or all proposals. |
