Description | The work includes the furnishing of all labor, materials and equipment necessary to complete the work as shown on the Drawings and as described in the Specifications. The work consists of the demolition and removal of existing storm sewers, installing new storm sewers and concrete ditch lining, emergency generator and miscellaneous electrical improvements at the South Second Street Pumping Station. The work is located between Geneva and South Second Street along Third Avenue, along South Second Street, west of Third Avenue intersection, along a section of Elizabeth River between South Second Street and South First Street, within the City of Elizabeth, and shall be completed within 300 calendar days of the Contractor's receipt of written Notice to Proceed. Each bid must be accompanied by a certified check, cashier check or surety bond of a corporation acceptable to the City and in the amount of ten percent (10%) of the total amount of the bid presented, but in no case in excess of $20,000.00. Each bidder must also submit with his bid a certificate from a responsible surety company stating that the said surety company will provide, in the event that he should be the successful bidder, a surety bond in the amount of one hundred percent (100%) of the contracted price and subject to such conditions as contained in the specifications. No bids will be received after the time and date specified, and no bids will be received by mail. Any award with respect to this matter is specifically contingent upon the availability of sufficient funds having been appropriated in the municipal budget. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27, N.J.S.A. 40A:11-21, N.J.S.A. 40A:11-22, N.J.S.A. 40A:11-23.1, N.J.S.A. 40A:11-23.2, P.L. 1999, Chapter 238, as well as the requirements of N.J.S.A. 52:25-24.2 of the State of New Jersey as amended. All bids shall include a commitment to the use of small, minority, women's and labor surplus area businesses and shall be in conformity with N.J.A.C. 7:22-3.17(a) or 7:22-6.17(a)(24) with a goal of not less than 10% participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SED's). The Contract is expected to be funded in part with the funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the United States nor the State of New Jersey, the New Jersey Environmental Infrastructure Trust, nor any of their departments, agencies, or employees is, or will be, a party to the Contract or any lower tier contract or subcontract. The Contract or Subcontract is subject to the provisions of N.J.A.C. 7.22 3, 4, 5, 9 and 10. Attention of bidder is particularly called to the requirements of Chapter 2.92 (formerly Chapter 65) of the Code of City of Elizabeth as supplemented and amended which requires the submission of certain affidavits which shall be considered by the City, in its determination of the responsibility of the lowest bidder. The City specifically reserves the right to waive any bidding irregularities with regard to the bidding requirements and as determined to be immaterial. The award or rejection of a contract for the within project is subject to the time limitations set forth in N.J.S.A. 40:11-24 which requires the award of the contract within 60 days of the bid opening, except that the bids of any bidders who consent thereto may, at the request of the contracting unit, be held for consideration for such longer period as may be agreed. The successful bidder will be required to furnish the required bond and certificates of insurance and to execute the contract within ten (10) calendar days from the award of the contract. Construction must begin within ten (10) calendar days after written notice to do so shall have been given to the Contractor by the Director of Public Works, and shall be carried on regularly and uninterruptedly, at a rate to insure its full completion within the specified calendar days after such notice. If at the time of award of the contract, the successful bidder has one or more contracts for projects with the City or is subsequently awarded a contract for other projects with the City than it will be required to work concurrently on all projects without interruption or delays. Shipping charges are additional and variable depending upon the pick-up or delivery option selected by the purchaser. Bid documents cannot be obtained at the City of Elizabeth or at Mott MacDonald's office. City Council reserves the right to reject any or all bids or any part thereof, in accordance with applicable law. |
