Description | The Work includes the Removal and Replacement of the 5,000 gallon Underground Storage Tank, and all associated work, at Windham Center Elementary School, 45 North Road, Windham Center, CT. Award of Contract shall be made to the lowest, responsible and qualified bidder. Bidders are directed to Section 5.3 of the Supplementary Instructions to Bidders regarding Consideration of Bids for this project. The Town of Windham reserves the right to reject any and all bids; to waive technical defects and to make such awards including accepting a bid, although not the low bid, as it deems in its sole discretion to be in the best interest of the Town. The Owner further reserves the right to accept or reject any part of any bid received; to present and negotiate terms of a contract together or separately with any party submitting a bid; to issue further requests for bids; to determine qualifications exclusively and finally; to request additional or refined bids from any person; to select any bid or part thereof based on any combination of factors, including the amount bid, the time of completion, and Owner's best interests. The Owner further reserves the right to retain all proposals submitted and to use any ideas in a bid regardless of whether that bid is selected. All bids must be accompanied by a 5% bid bond or Certified Check and the successful bidder is required to provide a 100% Performance Bond and Labor and Material Bond. No bidder may withdraw his bid for a period of ninety (90) days after the date of bid opening. The successful bidder must file a Performance Bond, Labor & Materials Bond and a Certificate of Insurance with the Finance Director within ten (10) days of notice of bid award. In accordance with Connecticut General Statute Sections 4a-100 and 4b-91, a responsible bid must contain two (2) documents: The Contractor Prequalification Certificate and the Update (Bid) Statement. The Town of Windham is an equal opportunity employer and requires an affirmative action policy for all of its Contractors and Vendors as a condition of doing business with the Town, as per Federal Executive Order 11246. This contract is subject to Prevailing Wage rates, State set-aside and contract compliance requirements. The contractor who is selected to perform this State project must comply with CONN. GEN. STAT.a-60, 4a-60a, 4a-60g, and 46a-68b through 46a-68f, inclusive, as amended by June 2015 Special Session Public Act 15-5. State law requires a minimum of twenty-five (25%) percent of the state-funded portion of the contract for award to subcontractors holding current certification from the Connecticut Department of Administrative Services ("DAS") under the provisions of CONN. GEN. STAT. 4a-60g. (25% of the work with DAS certified Small and Minority owned businesses and 25% of that work with DAS certified Minority, Women and/or Disabled owned businesses.) The contractor must demonstrate good faith effort to meet the 25% set-aside goals. |
