Carpet Replacement at Multiple School Sites

The Contractor and its surety shall be liable to the District for any damages arising as a result of the Contractors failure to comply with this obligation, and the Contractor shall not be excused with respect to any failure to so comply by act or omission of the Construction Manager, Architect, Engineer, Inspector, Division of the State Architect, or representative of an of them, unless such act or omission actually prevents the Contractor from fully complying with the Contract Documents and the Contractor protests, in accordance with the Contract Documents that the act or omission is preventing the Contractor from fully complying with the Contract Documents. Such protest shall not be effective unless reduced to writing and filed with the District office within five (5) days of the date of occurrence of the act or omission preventing the Contractor from fully complying with the Contract Documents. The Contractor shall perform all Work within the time stipulated the Contract and shall provide all labor, materials, equipment, tools, utility services, and transportation to complete all of the Work required in strict compliance with the Contract Documents as specified in Article 5 below for the following Project: Refer questions to Susan Harautuneian via email @ susanharautuneian@maderausd.org no later than February 24, 2023 @ 10:00 am. Only questions received via email will be responded to. Bidders shall be required to have a valid class "B" and/or "C-15" Contractor's License.
