Description

Furnishing to said City all labor, materials, equipment, transportation, and services for the drilling a 710-foot-deep pilot hole, conducting geophysical logging and water quality sampling in the pilot hole, reaming the pilot hole and constructing a 690-foot deep production well, using the reverse rotary drilling method. The work includes supplying all labor, materials, and equipment, performing all drilling, geophysical logging, zone sampling, testing, developing, and test pumping, placing all casing, gravel pack and seals, and cleanup at the site specified herein. Any contract entered into pursuant to this notice will incorporate only the applicable provisions of the State Labor Code. Compliance with the prevailing rates of wages and apprenticeship employment standards established by the State Director of Industrial Relations will be required. As per SB854, passed by California State Senate on June 20, 2014, contractors and subcontractors will now be required to register with the California Department of Industrial Relations (DIR) per Section 1725.5 of the Labor Code. Affirmative action to ensure against discrimination in employment practices on the basis of race, color, national origin, ancestry, disability, gender, age, sexual orientation, or religion will also be required. No qualified disabled person shall, on the basis of disability, be excluded from participating in, be denied the benefits of, or otherwise be subject to discrimination. The City hereby affirmatively ensures that minority business enterprises will be afforded full opportunity to submit bids in response to this notice and will not be discriminated against on the basis of race, color, national origin, ancestry, disability, gender, age, sexual orientation, or religion in any consideration leading to the award of contract. The right is reserved by the City of Porterville to reject any or all bids, to evaluate the bids submitted and to award the contract according to the proposal which best serves the interests of said City. The successful bidder will be required to furnish the City of Porterville with a "Performance Bond" in the amount of one hundred percent (100%) of the contract and a "Labor and Materials Bond" in the amount of one hundred percent (100%) of the contract amount. Upon receiving the "NOTICE OF AWARD," the successful bidder has TEN (10) DAYS to submit the signed contract together with all required bonds, insurance and licenses to the Project Manager, and meet with the City in a PRE-CONSTRUCTION MEETING to discuss any problems or questions pertaining to this project. It is the Contractor's responsibility to contact the City's Project Manager immediately, to arrange for the PRE-CONSTRUCTION MEETING during the TEN (10) DAY PERIOD. The Contractor shall have fifty (50) working days from the effective date of the NOTICE TO PROCEED to complete the required work. The Contractor shall pay the City LIQUIDATED DAMAGES in the amount of TWO THOUSAND FIVE HUNDRED DOLLARS ($2,500.00) a day for each calendar day the project is delayed beyond the "TIME OF COMPLETION DATE." The City will withhold five percent (5%) retention from payments due the Contractor until thirty-five (35) days after date of recordation of the Notice of Completion. The Contractor may elect to receive one hundred percent (100%) of payments due under the contract by depositing securities of equivalent value with the City in accordance with the provisions of the California Public Contract Code Section 22300. Such securities, if deposited by the Contractor, shall be valued by the City, whose decision on valuation of the securities shall be final. Securities eligible for investment under this provision shall be limited to those listed in Section 22300 and Section 16430 of the California Government Code. A log of borings is contained in the appendix for use by the Contractor. It is intended to aid the Contractor in establishing the type of soils to be encountered but may or may not be indicative of all soil types to be found throughout the project limits. A Certified Check, Cashier's Check, or Bidder's Bond in the amount of ten percent (10%) of the bid made payable to the City of Porterville will be required to accompany each proposal.
