Description

For Refuse Removal Seven Schools Bids must be prepared and submitted in accordance with the Instruction to Bidders, and N.J.S.A. 18A:18A, Public Schools Contract Law. Bids must include or be accompanied by: (1) A Commitment of Surety, from a surety qualified under applicable New Jersey law, evidencing that the Successful Bidder for any Contract(s), or for a Combined Contract, will furnish in the forms provided, bonds satisfying the requirements of the Bidding Documents as follows: a. Performance and Payment Bonds in the amount of One Hundred Percent (100%) of the Contract Price. (2) Bid Security, Bid Bond or (Cashiers or Certified Check), in the form specified in the Bidding Documents to the order of the Caldwell-West Caldwell Board of Education, in an amount of not less than ten 10% percent of the total amount of the bid, not to exceed Twenty Thousand $20,000 Dollars as per N.J.S.A. 18A:18A-24; and, (3) Performance Bond Guarantee Certificate (Power of Attorney on Bid Bonds of Surety). (4) Notice of pre-qualification and classification as required under P.L. 2000, c.72 N.J.S.A. 18A:7G-1 et.seq. (5) A Non-Collusive Affidavit; and, (6) A Disclosure Statement setting forth names and addresses of all stockholders or partners who hold more than 10% or greater interest in accordance with N.J.P.L. 1977, C-33 enacted March 8, 1977; and, (7) Certificates of Registration under the Public Works Contractor Registration Act (P.L. 1999, c238) for the bidder and all subcontractors identified in the bid. (8) Where the Bidder is a Foreign Corporation, appropriate evidence of authorization to do business within the State of New Jersey. (9) Mandatory Affirmative Action Language as required under PL 1975, C127-Form No. 1 Affirmative Action Acknowledgment. (10) Statement of Bidders Experience. (11) The identity of any Subcontractor proposed by the Bidder for use on any portion of the work. (12) State of New Jersey Business Registration Certificate. (13) FORM OF PROPOSAL: Each of the foregoing may be deemed mandatory as allowed by law, by the Owner, and failure to provide the foregoing as set forth above, may be deemed by the Owner, except as otherwise required by statute or other law, as non-responsive to this Bid Solicitation. Contractors bidding on the project are to comply with the requirements of: 1. Bidding and Award will be in compliance with the Public School Contracts Law, N.J.S.A. 18A:18A-1 et seq. 2.Law Against Discrimination(N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27-1 et seq.). 3. Prevailing Wage Rate Determination (N.J.S.A. 34:11-56.25 et seq. pursuant to Chapter 150 of the NJ Laws of 1963). 4. Domestic Materials only to be used for this project, as per 18A:18A-20. Pursuant to 18A:18A-22 a board of education may reject all bids as per statute. Bids may not be modified after submittal. Bidders may withdraw bids any time prior to bid opening. Caldwell-West Caldwell Board of Education shall award contracts, or reject any or all bids, within sixty (60) days unless otherwise agreed by the parties. Owners Disclaimer/Owners Discretion to Accept or Reject Bids: The Owner assumes no responsibility, whatsoever, in connection with any defects arising out of the Bidding Documents or the receipt or failure to receive Bids, including those which may arise from delay for any reason, in obtaining or submitting the Bidding Documents, including but not limited to, traffic delay, messengering, mis-labeling, mis-direction from any source, mis-delivery, or otherwise. Any Bid, which does not fulfill the material requirements of the Bidding Documents, will be rejected. When it is in its best interest to do so, the Owner may waive any informality in or reject any or all Bids.
