Description | As of December 06th, 2022, project has not been formally awarded yet. It is expected to be awarded sometime after January 24th of next year. For construction in accordance with the project plans and specifications to which special reference is made, as follows: Title: Municipal Parking Lot No. 8 Improvement Project No. 05740 The work consists, in general, of pavement improvement, reconstruction of curb & gutter, sidewalk, curb ramps, 6" island curb for landscape planting, LED light fixture replacement, wheel stops, and signages, and performing other items or details, not mentioned above, that are required by the plans, and as specified in the Standard Specifications or these Special Provisions. The Engineers estimated cost of construction is $590,000.00. The anticipated start date of construction is tentatively, January 2023. The work shall be completed within forty-five (45) of working days. The Contractor shall pay to the City of Hayward the sum of $1,000.00 per day more than the number of calendar day's prescribed above, for each calendar day's delay in finishing the work. See details in the Special Provisions. At the time this contract is awarded, the Contractor shall possess either a Class A license or a combination of any of the following license classifications which constitute a majority of the work: C-8 and C-12. When the Engineer's estimated cost of construction is greater than $1,000,000, the contract is subject to the Community Workforce Agreement approved by the Hayward City Council on April 14, 2015. The successful bidder and all subcontractors, at any tier, will be required to sign an Agreement to be Bound which can be found in Exhibit G in the Special Provisions as a condition precedent to entering into any contract for this project. Pursuant to Section 1770 of the Labor Code, the Director of the Department of Industrial Relations has ascertained the general prevailing rate of per diem wages applicable to the work to be performed, which rates are filed in the office of the Engineer, and copies of which are available to any interested parties on request. In accordance with Labor Code Section 1771.1, a contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, or engage in the performance of any contract for public work unless currently registered with the State Department of Industrial Relations and qualified to perform public work pursuant to Labor Code Section 1725.5. Section 1771.1 applies to any bid proposal submitted on or after March 1, 2015 and/or any contract for public work entered into on or after April 1, 2015. Job Site Notices. Contractor shall post a Job Site Notice for this project pursuant to Title 8 California Code of Regulations Section 16451. A bid submitted by any Contractor who is not licensed to engage in business or act in the capacity of a Contractor shall be considered non-responsive and shall be rejected, except for those exceptions governed by Section 7028.15 of the Business and Professions Code. The City of Hayward hereby notifies all bidders that bidders will not be discriminated against on the grounds of race, color, religion, national origin, ancestry, place of birth, sex, sexual orientation, age, or disability in consideration for an award. Bidders are required to submit any questions in writing, via e-mail to hector.leuterio@hayward-ca.gov no later than Tuesday, November 22, 2022 by 4:00 p.m., no exemptions. No other questions will be received after the deadline. Only written inquiries will be permitted. Each bid must be accompanied by certified or cashier's check, or bidder's bond duly executed by a responsible corporate surety authorized to issue such bonds in the State of California, made payable to the City of Hayward for an amount equal to at least ten (10) percent of the amount bid. The successful bidder shall furnish a Labor and Materials Bond and a Faithful Performance Bond. Each Bond shall be for 110% of the bid amount. Bidder's attention is directed to Section 6-1, "City of Hayward Non-Discriminatory Employment Practices Provision," of the Special Provisions. Pursuant to Section 1773 of the Labor Code, the general prevailing wage rates in the county, or counties, in which the work is to be done have been determined by the Director of the California Department of Industrial Relations. These wages are set forth in the General Prevailing Wage. Rates for this project available at the office of the City Engineer and available from the California Department of Industrial Relations internet web site or appropriate. Future effective general prevailing wage rates, which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates. The Contractor may elect to receive 100 percent of payments due under the contract from time to time, without retention of any portion of the payment by the City, by depositing securities of equivalent value with the City in accordance with the provisions of Sections 22300 of the Public Contract Code. All expenses of such substitute deposit shall be borne by the Contractor. Securities eligible for investment under the section shall include those listed in Section 16430 of the California Government Code or certificates of deposit of a bank or savings and loan association. The Contractor shall be the beneficial owner of any securities substituted for monies withheld and shall receive any interest thereon. Such securities, if deposited by the Contractor, shall be valued by the City's Finance Director (Treasurer), whose decision on valuation of the securities shall be final. Alternatively, upon the Contractor's request, the City will make payment of retentions earned directly to the escrow agent. The Contractor may direct the investment of the payments into securities, and the Contractor shall receive the interest earned on the investments upon the same terms provided for securities deposited by the Contractor. Upon satisfactory completion of the contract, the Contractor shall receive from the escrow agent all securities, interest and payments received by the escrow agent from the City, pursuant to the terms in Section 22300 of the Public Contract Code. Prospective bidders and interested parties may download copies of the bid documents, related attachments and all future communication and correspondences regarding this bid process from Construction Bidboard at www.ebidboard.com. The City's current advertised projects on ebidboard can be assessed, and bid documents downloaded for FREE, through the City's website at https://www.hayward-ca.gov/business/doing-business-with-hayward/bidding-construction. The City of Hayward will not be a distribution point for the bid documents. The bid documents may also be reviewed at the various builders' exchanges and construction service offices throughout the San Francisco Bay Area. All questions abut the meaning or intent of the Bidding Documents are to be submitted to City's project manager by email interpretations or clarifications considered necessary by City in response to bidder questions will be issued by Addenda delivered to all registered plan holder. Questions received less than 5 days prior to the date for opening of Bids may not be answered. Only questions answered by Addenda will be binding. Oral and other interpretations or clarifications will be without legal effect. Project Addendum notifications will be issued through Construction Bidboard at www.ebidboard.com. Construction Bidboard will fax and/or email all notifications to all registered plan holders. Bidders must be registered plan holders in order to receive notification including notice of any addenda that are issued for this project. Addenda are required to be acknowledged on the Proposal Form. Failure to acknowledge all addenda may result in the Proposal being rejected. |
