Description

It is the intent of this solicitation to secure pricing on various tree species suitable for planting as street trees within the City of Lancaster, as well as parks, public properties and the public right-of-way. The resulting Agreement will govern the procurement and supply of such trees for a 3-year period from the date of execution, with a City option to renew the same for two additional 1-year periods. Multiple Agreements may be awarded in the event that a sole bidder is unable to supply the entire inventory of the tree species requested. If multiple bids are awarded, they should parse according to the three categories presented on the species list: Non-Native, Native and Bareroot. To qualify for bidding on any one category, bidders must meet minimum total species requirements and provide pricing accordingly. Bidders may provide pricing on more than one category, provided the minimum total species requirements are met for all categories bid upon. All bids shall be effective for sixty (60) calendar days from the date of the bid opening, unless an award of the Contract is delayed by the required approval of another governmental agency, the sale of bonds or the award of a grant, in which case all bids will remain effective for One Hundred Twenty (120) calendar days from the date of the bid opening. The successful bidder will be required to provide a performance bond equal to one hundred (100%) percent of the Contract price with suitable, reasonable requirements guaranteeing the performance of the Contract. This Project and Contract is subject to certain special requirements. For example, as more specifically detailed in the Contract documents, the successful bidder shall be required to assure protection against discrimination for employees, applicants for employment, and subcontractors on the grounds of actual or perceived race, color, sex, religion, ancestry, genetic information, national origin, sexual orientation, gender identity or expression, familial status, marital status, age, mental or physical disability, use of guide or support animals and/or mechanical aids. The City will determine who is the lowest responsible bidder upon the basis of the bids submitted. The lowest responsible bidder need not be the bidder submitting the lowest dollar amount. The City may consider the quality of services supplied, responsiveness of the bidder, past performance of the bidder, compatibility of the bidder's processes with other City services and the bidder's ability to deliver the materials within the time required. The City reserves the right to reject any or all bids and re-advertise if the best interest of the City will thereby be promoted. The City also reserves the right to waive technical defects if in its judgment, the interest of the City shall so require. The City further reserves the right to waive any informalities in the bids received and reject any or all bids for any reason whatsoever. Included in its right to reject bids, is the right for the City, in its sole discretion, to reject proposals which are deemed by the City to be incomplete, conditional, or obscure, or which contain additions, erasures, alterations, omissions or irregularities of any kind. In reviewing the bids, the City will review the bidder's experience, necessary facilities and financial resources to furnish the items of this Contract and the City reserves the right to reject the proposal of any bidder not possessing satisfactory qualifications.
