Description | All potential bidders are encouraged to attend the tour to gain firsthand knowledge of the project's scape. All references, questions and request for clarifications concerning the bid documents and/or plans & specifications shall be made in writing on the bidders company letterhead and emailed to Michael Elkin email to melkin@ganda.biz, with subject: EOPL 2020, by 4:00pm, Thursday, November 10, 2022; questions received after this date shall not receive a response.Responses to all inquiries shall be forwarded, through email to all parties that have taken out bid packages. Only cashier's checks or certified checks shall be accepted. All bids shall be hand delivered by the bidder or courier at the time and day of the bid opening; mailed bids shall not be accepted. Bidders may not submit more than one Bid. Bidders shall be required to submit a Bid Bond or a certified check payable to the order of the City of East Orange for not less than 10 percent of the amount of the Base Bid, provided paid check need not be more than $20,000.00. The Bid Bond or certified check shall bind the Bidder directly to the Contract and furnish the Performance Bond within ten (10) days after notification of the acceptance of the Bid. Upon failure of any successful Bidder to execute the necessary Contract and furnish a Performance Bond, their deposit shall be applied on account of the Owner's claim for damages and in no case be considered as liquidated damages. Bidders are put on notice that they shall be required to comply with the following statutes of the State of New Jersey as they may apply to individual Bids and any Contract award made: These statutes include but are not limited to: N.J.S.A. 40A:11-1 et. seq. Local Contract law N.J.S.A. 10:5-12 et.seq. NJ Law Against Discrimination N.J.S. 54:32B-1 et. seq. NJ State Sales & Use Tax N.J.S. 52:25-24.2 et. seq. State of Ownership The provisions of these statutes shall become part of any Agreement entered into between the Owner and a successful Bidder and said provisions shall be deemed to have set forth at length in the Contract whether specifically set forth at length or not. In addition, as indicated in the Bid Project plans and specifications, Bidders are also required to comply with: N.J.S. 40A:11-1 et. seq. Bid Security N.J.S. 40A: 11-32 et. seq. Consent of Surety N.J.S. 52:34-15 et. seq. Non-Collusion Affidavit No Bids shall be accepted that do not conform to the project plans and specifications. |
