Description | The Town of Black Mountain (hereinafter called the "Town") invites qualified independent contractors (hereinafter called "contractor") having sufficient experience in purchasing of materials and constructing recreational facilities in accordance with the specifications outlined in this Request for Proposal (RFP) to submit a proposal for a restroom facility. There is no expressed or implied obligation for the Town of Black Mountain to reimburse contractors or firms for any expenses incurred in preparing proposals in response to this request. The specific details shown herein shall be considered minimum unless otherwise shown. The specifications, terms, and conditions included with this RFP shall govern in any resulting contract(s) unless approved otherwise in writing by the Town of Black Mountain. The bidder consents to personal jurisdiction and venue in a state court of competent jurisdiction in Buncombe County, North Carolina. The Town of Black Mountain seeks to transform Veterans Park into a vibrant activity area for children, families, and community groups. The Town is requesting proposals for the purchasing of materials, construction and installation of an ADA accessible restroom facility as part of improvements being made to Veterans Park through a PARTF Grant. Veterans Park encompasses 27.2 acres in the French Broad River Basin along the Swannanoa River on Veterans Park Drive at the intersection of Blue Ridge Road. The park extends by greenway trail underneath Interstate 40 onto the south side of Blue Ridge Road and White Pine Drive. The majority of improvements will be installed along the north side near the ballfields. The Town seeks a proposal which includes a site plan, detailed material and construction estimates and installation costs. This project must be ADA accessible as part of improvements to Veterans Park. This project must be completed by September 30, 2022. Bids shall be submitted for materials, site preparation and installation and any other applicable permitting fees or charges. Fees and charges for shipping, freight, and taxes shall be included in the proposal. Upon award of the contract, the successful applicant should prepare billing in line with the PARTF contract line item cost estimates. The successful vendor shall comply with and perform the services in accordance with all applicable Federal, State and Town laws including, without limitation, all Town codes, ordinances, standards and policies as now existing or hereafter adopted or amended including but not limited to the following: Construction for new restroom facilities. Provide an itemized list of services, equipment and costs to complete the project. b. An electronic copy (submitted via flash drive) as well as 3 print copies of the proposal and any supporting materials shall be submitted. c. Proposals shall clearly indicate the legal name, address, telephone number, e-mail address, website, if any, and fax number of the submitting entity (e.g., company, partnership, or individual) on the title page. d. Proposals shall bear an original signature, being signed above the typed or printed name and title of the signer. Proposals must be signed by an officer of the business authorized to bind the Vendor to a contract. Indemnification: Vendor shall protect, indemnify and save the Town harmless from and against all liabilities, damages, losses, claims, actions, costs and expenses of any nature resulting from injuries or damages to persons or property on or about the Town property arising out of or in any manner connected with the use, condition or occupancy of the Town property by Vendor or any act or omission of Vendor, its agents, vendors or employees. Insurance: Vendor agrees to maintain, at its expense, at all times during the project on Town property, comprehensive general liability insurance, with a minimum amount of $1,000,000 per occurrence, properly protecting and indemnifying the Town and naming the Town as an additional insured, written by insurers licensed to do business in the State of North Carolina. Vendor shall provide the Town a certificate of such insurance, which shall provide that the insurer shall not cancel or alter the policy without giving the Town written notice at least thirty (30) days in advance. Liability: Vendor agrees that all property of Vendor in, on or about the Town property shall be at the sole risk and hazard of Vendor. The Town shall not be liable or responsible for any loss, injury or damage to Vendor or any property or business of Vendor, including any theft or damage caused by any invitees, vendors, employees or members of the public. |
