Electric System Construction Contract

Electric system construction contract (labor only for non-site specific construction) P038-23 with a maximum aggregate contract price not to exceed $3,500,000, and a maximum annual aggregate contract price not to exceed $2,187,500 of the public utilities board of the city of Brownsville, Texas, (hereinafter called the "Owner" or "BPUB" The unit prices in the contractor's proposal are to include labor and equipment only. All non-consumable materials will be provided by owner herein after "Owner furnished materials." Questions concerning terms, conditions, and technical specifications should be directed to: Hugo e. Each bid must be accompanied by a certified or cashiers check, or a bid bond prepared on the form of the bid bond attached hereto, duly executed by the bidder as principal and having as surety therein a surety company approved by the owner, and authorized to do business in the state of Texas, in the amount of not less than five (5%) percent of maximum annual aggregate contract price of a not to exceed amount of $2,187,500. Such checks, or bid bonds will be returned to all except the three lowest bidders within fifteen (15) days after the opening of bids, and the remaining checks, or bid bonds will be returned promptly after the owner and the accepted bidder have executed the contract or if no award has been made, within thirty (30) days after the date of the opening of bids. The bid security will be returned upon demand of the bidder at any time thereafter, so long as he has not been notified of the acceptance of his bid. The successful bidder, upon his failure or refusal to execute and deliver the contract, bonds and insurance certificates required within ten (10) days after he has received notice of the acceptance of his bid, shall forfeit to the owner, as liquidated damages (and not as a penalty) for such failure or refusal, the security deposited with his bid BPUB general conditions addendum: payment and performance bond. The contractor shall provide payment and performance bonds, based on the amount or estimated amount of any future section. For the purpose of this proposal, bidder shall attach a letter of intent from a qualifying surety company indicating the applicants bond ability for this project of no less than the maximum annual aggregate contract price not to exceed $2,187,500 under this contract
