SOLICITATION NUMBER: 47PJ0023R0059 PROJECT TITLE: Pembina Sprinkler Head Corrections, Pembina, North Dakota DESCRIPTION OF PROPOSED WORK: The purpose of this project is to install sprinkler heads under 24 garage doors located in 2 buildings at the Pembina Border Station. MAGNITUDE OF CONSTRUCTION: The estimated price range of this project is between $25,000 and $100,000. NAICS CODE AND DESCRIPTION: 238220, Plumbing, Heating, and Air-Conditioning Contractors. SMALL BUSINESS SIZE STANDARD: $19.0 million TYPE OF SET-ASIDE: This procurement is set aside for award to qualified small businesses. Offers from other businesses including large businesses will not be considered. LOCATION OF THE WORK: Pembina, Pembina County, North Dakota DATES: Solicitation Issue: April 28, 2023 Offers Due: 4:00 p.m. CT on May 19, 2023 PROCEDURES FOR AWARD: The Government intends to award a contract resulting from this solicitation to the responsible offeror whose proposal conforms to the Solicitation will be most advantageous to the Government, Price and other factors considered. The Government intends to award without discussions but reserves the right to do so. AMENDMENTS TO SOLICITATION: It is the offeror's responsibility to monitor the GPE site at sam.gov for the release of any amendments. AWARD RESTRICTIONS: This procurement is offered for competition limited to eligible small business concerns. BONDING: 40 U.S.C. chapter 31, subchapter III, Bonds (formerly known as the Miller Act), requires performance and payment bonds equal to 100 percent of the original contract price for any construction contract exceeding $150,000. Pursuant to 40 U.S.C. 3132, for construction contracts greater than $35,000, but not greater than $150,000, the awardee may provide one of the following alternative payment protections: (i) A payment bond. (ii) An irrevocable letter of credit (ILC). (iii) A tripartite escrow agreement. (iv) Certificates of deposit. (v) A deposit of the types of security listed in 28.204-1 and 28.204-2. SECURITY: All personnel are required to comply with the HSPD-12 directive prior to beginning work at this project site. Forms will be provided to the successful offeror after award. BUY AMERICAN ACT / TRADE AGREEMENTS: This procurement is subject to the requirements of the Buy American Act. Per Federal Acquisition Regulation (FAR) 25.401(a)(1), trade agreements (such as NAFTA) do not apply to acquisitions set aside for small businesses. Accordingly, any offeror proposing the use of foreign construction material, other than those articles listed in FAR 25.104, must request an exception to the Buy American Act as described in FAR Part 25.2. Such an exception must then be approved by the Government before the requested material may be used in this construction project.
