Each bid shall be accompanied by a Certified Check on a solvent bank or a Bidder's Bond issuedby a Surety Company licensed to operate in the State ofMississippi, in the amount offive percent (5%) ofthe total bid price, payable to the City of Hattiesburg as bid security. Bidders shall also submit a current financial statement, ifrequested by the City. The successful bidder will be required to furnish a performance and payment bond in the amount of one hundred percent (100%) ofthe contract amount. Both bonds shall be signed or countersigned by a Mississippi Resident Agent. The City of Hattiesburg reserves the right to reject any or all proposals, to waive technicalities or irregularities, orto advertise for new proposals, and the decision ofthe City ofHattiesburg to reject any bid or proposal shall not be cause for any liability or damages against the City of Hattiesburg, any officers or employees. The biddermust agree to commence work on orbefore a date to be specified in a written "Notice to Proceed" ofthe Owner and to fully complete the project within the Contract Time. The bidder must also agree to pay as liquidated damages the sum specified in the Standard Specifications per day for each calendar day of overrun in Contract Time that work is not completed. Workto be performed shall be in accordancewith the "Mississippi State Highway Standard Specifications for Road andBridge Construction, 2017", togetherwith all amendments and/orspecial provisions and/or addenda to the standards duly approved and adopted, unless otherwise noted in these specifications.
