Description | This Request for Bids ("RFB") involves all necessary labor, tools, equipment, material, and services for rehabilitation of Primary Tank No. 2 including structural repairs and enhancements to the traveling bridge; replacement of skimmers and scrapers; replacement of drives, shafts, couplings, and bearings; replacement of steel wheels and cog wheels; replacement of steel rails, cog teeth and accessories; new control cabinet with motor starters and controllers; installation of a maintenance platform and control cabinet canopy; and, abrasive blasting and coating of the structure. For Primary Tank No. 5 a maintenance platform and control cabinet canopy shall be installed and coated and for all Primary Tanks (No. 1 thru 6) the electrical junction boxes shall be replaced. Bids not meeting these requirements will be considered non-responsive and will be rejected. Each Bidder must submit with its Bid, Bid Security in the form of a Bid Bond executed by the Principal and Surety Company Attorney in Fact and witnessed to and attested with an appropriate Power of Attorney attached, or a cashier's check, or treasurer's check or certified check or money order made payable to the order of the Treasurer, Middlesex County Utilities Authority and in the amount of ten percent (10%) of the Bid price, not to exceed $20,000.00. In addition to the Bid Security, each Bid must be accompanied by a Consent of Surety written by a Surety Company listed on the Federal Treasury List (Environmental Protection Department Circular 570-Surety Companies Acceptable on Federal Bonds) as required by N.J.A.C. 7:22-3.17(g) and N.J.A.C. 7:22-4.17(g), and is licensed to do business in New Jersey and acceptable to the Authority, that in the event of an award of the Contract to the Bidder, said Surety will furnish the required contract bond(s) in the sum of the full amount of the Bid as set forth and as required in the RFB. The contract bond(s) for this RFB include the following and must be from a surety company acceptable to the Authority and satisfying the requirements of the RFB: - Performance Bond - Labor and Materials Payment Bond - General Maintenance Bond - Environmental Maintenance Bond The Successful Bidder will be required to present to the Authority the approved contract bonds duly executed and be prepared to execute the Contract within fifteen (15) days of the date of receipt of the Notice of Contract Award. All Bidders and named Subcontractors must possess current and effective Public Works Contractor Registration Certificates (PWCR) as of the Bid opening date. A Bidder who does not possess a valid PWCR as of the Bid opening date, or who names any Subcontractor in its Bid who does not possess a valid PWCR as of the Bid opening date, will be deemed ineligible for contract award. Bidders are requested to submit copies of all applicable PWCR certificates with their Bids. If copies of any of these certificates are omitted from the Bid, they shall be provided to the Authority within five (5) business days of its request. Notwithstanding any failure to provide copies of these certificates, however, the Authority shall have the right to independently verify Bidders' and named Subcontractors' PWCR status from computerized systems maintained by the State and shall be guided accordingly in its award process. Should the Successful Bidder fail to comply with the time provisions set forth above, the Authority may, at its direction, declare the Successful Bidder in default and the Contract abandoned, and the Authority may take such proceedings as it deems necessary in the best interests of the Authority. Bidders are required to comply with the requirements of P.L.1975, c.127; N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27, et seq., as amended and supplemented, Affirmative Action and Equal Employment Opportunities; N.J.S.A. 52:25-24.2, Disclosure of Interests, as amended and supplemented; applicable minimum State of New Jersey Labor Standards; the Buy American provisions; and American with Disabilities Act of 1990 provisions of the Contract. Additionally, each Bidder shall submit a Certification on Non-Segregated Facilities. The Bidding and award of the Contract will be in compliance with the New Jersey Local Public Contracts Law (N.J.S.A. 40A:11-1 et seq.). This Contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this Contract or subcontract or any lower tier contract or subcontract. This Contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3,4,5,9 and 10. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the Successful Bidder (Subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9 for the participation of small business enterprises owned and controlled by socially economically disadvantaged individuals (SEDs). The Successful Bidder must comply with the Project Plan developed by the Middlesex County Utilities Authority (Project Sponsor), that is part of the Contract, to fulfill SED utilization. These requirements include: Pursuant to the N.J.A.C. 7:22-3.17(a) 24 and N.J.A.C. 7:22-4.17(a) or N.J.A.C. 7:22-6.17(a)24, it is the Goal of this RFB that not less than ten percent (10%) of the total amount of all contracts related to this Project for building, materials and services be awarded to small business concerns owned and controlled by Socially Federal Small Business Act [15 U.S.C. 637(a) and 637(d)], and any Regulation promulgated pursuant thereto. Within thirty (30) days of receipt of Notice of Contract Award, the Successful Bidder shall submit an SED Plan setting forth how the SED Utilization Requirements for this Contract shall be achieved over the duration of the Work. Guidance for implementation of said SED Plan is set forth in Appendix G, including the Authority's SED Plan; NJDEP Guidelines for Development and Submission of a Project Plan for the Project Sponsor and the Contractor; N.J.S.A. 52:32:17 et seq. an N.J.A.C. 7:22-9 et seq.; and required SED Forms OEO-002 and OEO-003. The Successful Bidder shall comply with N.J.A.C. 7:22-9.1 as set forth as an Attachment in the RFB. The Successful Bidder shall execute the Certification set forth in Exhibit G-6 thereby committing to comply with the Authority's SED Utilization Plan and other special SED Requirements as set forth herein.
