Description

Construction of new 24 water main extension along SW 21st Street to replace the existing 1920's 12" cast iron water line. The work consists of the construction of approximately 2,700 LF of 24" water transmission main, 1,300 LF of 16", 12", and 6" water distribution main, fire hydrants, valving, new service lines and meter pits, connections to the existing distribution system, abandonment of existing 12" water main, and concrete and asphaltic concrete pavement removal and replacement. BID CLOSING: Will be public following receipt of Bids at the office of the Contracts & Procurement Division, 215 E. 7th Street, Basement, Room 60, Topeka, KS 66603. All bids must be accompanied by a cashier's check or a bid bond for not less than five percent (5%) of the amount bid (including alternates), made payable to the City of Topeka, Kansas. The original bid security shall be in the office of Contracts and Procurement before the 2:00 closing date. The Work will be substantially completed within 240 days from the date when the Contract Time commences to run as provided in paragraph 2.3 of the General Conditions, and completed and ready for Final Completion and payment within 21 days from the date when Substantial Completion is certified by the Engineer and in accordance with paragraph 14.13 of the General Conditions. Owner reservesthe right to reject any and all Bids, to waive any and all informalities and to negotiate contract terms with the Successful Bidder within the limitations oftheCode ofthe City of Topeka. Owner reserves the right to reject all nonconforming, nonresponsive or conditional Bids. Discrepancies in the indicated multiplication of unit prices and quantities shall be resolved in favor of the correct multiplication based on the unit prices indicated. Discrepancies between the indicated sum of any column of figures and the correctsum thereof will be resolved in favor of the correct sum . Owner reserves the right to reject the Bid of any Bidder who does not pass any such evaluation to Owner's satisfaction. Provisions for liquidated damages are set forth in the Agreement. Owner and Contractor recognize that time is of the essence of this Agreement and that Owner will suffer financial loss if the Work is not completed within the times specified in paragraph 3.1 above, plus any extensions thereof allowed in accordance with Article 12 of the General Conditions. They also recognize the delays, expense and difficulties involved in proving in a legal preceding the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty) Contractor shall pay Owner according to the following schedule . Delays and Damages. Contractor shall accept the risk of any delays caused by the rate of progress of the work to be performed under other contracts. In the event Contractor is delayed in the prosecution and completion of the Work because of such conditions, Contractor shall have no claim against Owner for damages or contract adjustment other than an extension of Contract Times and the waiving of liquidated damages during the period occasioned by the delay. Bidder accepts the provisions of the Agreement for Liquidated Damages in the event of failure to complete the work on time. Liquidated damages, or if no liquidated damages are specified in the Contract, actual damages caused by delayed performance or non-performance of the Contract.
