Description

It is the Contractors responsibility to meet the minimum guidelines of the Occupational Safety and Health Act (O.S.H.A.), in particular Part 1926, the Safety and Health Regulations for Construction. The Town of Fenton has the authority to issue a Stop Work Order if the applicable O.S.H.A. regulations are violated. The Stop Work Order will remain in effect until such violations of the O.S.H.A regulations have been rectified. . No proposal will be considered unless it is accompanied by a bid guaranty which shall not be less than ten percent (10%) of the amount bid for the total work contemplated to be done. At the option of the Bidder, the guaranty may be a certified check, bank draft, or a bid bond approved by the Town Attorney. Certified check or bank draft must be payable to the order of the Town of Fenton. Cash deposits will not be accepted. The Bid guaranty shall insure the execution of the Agreement and the furnishing of the surety bond or bonds by the successful Bidder, all as required by the Contract Documents. Bidders submitting bid proposals for this work hereby acknowledge the following: Each laborer, workman, or mechanic employed by the Contractor, Subcontractor, or other person about or upon the work under this Contract, shall be paid not less than the prevailing rate of wages, and shall be paid for or provided the supplements not less than the prevailing supplements as determined by the New York State Department of Labor, pursuant to Article 8 of the New York State Labor Law. The prevailing rate schedule, as determined by the New York State Department of Labor (PRC# 2022002881 Nowlan Road Water Tank Replacement), is a part of this Contract, and can be obtained at the following website. The Contractor shall submit a certified copy of all payrolls with each payment requisition to the Town of Fenton. The prime Contractor shall be responsible for the submission of copies of payrolls of all Subcontractors. The Bidder agrees that this bid shall be good and may not be withdrawn for a period of 30 calendar days after the scheduled closing time for receiving bids. The Town will award the bid within 30 days after the scheduled closing time for receiving bids. The Town reserves the right to reject any and all bids and to award the Contract in the best interests of the Town of Fenton, New York.
