Lakeside Pond Bank Restoration Phase II

The Contractor will have four 20' access alley ways from Lakeside Drive to Lakeside Pond. The 20' access alleyways and staging areas are shown on Lakeside Pond Bank Restoration (Phase II). The only motorized equipment the Contractor will be allowed outside these areas from Lakeside Drive and Lakeside Pond is/are Sand Plate Vibrators. Any other equipment or vehicles located outside the designated alleyway, access route or staging area associated with Lakeside Park will result in a liquidated damage equal to $500/occurrence. The City shall determine based upon eyewitness accounts or objective evidence whether a violation has occurred. A new occurrence will be initiated for each piece of equipment or vehicle and for 15 minutes or part thereof of a violation. This applies to the Contractor, Subcontractors, employees or agents, but the penalty shall be assessed against the Contractor.
