Description

SCOPE OF WORK: Services are to be rendered covering the actual performance of mowing, trimming and clean up of properties as directed by the City Code Enforcement Department. MATERIALS: The materials used shall conform to law and shall be acceptable to the City. The contractor will be required to supply all equipment to complete mowing jobs including but not limited to: a push mower, a tractor (a bush hog mower), and also smaller equipment for smaller yards and clean up (trimmers and chain saw), and a Digital or 35 mm camera that mechanically prints date on each picture, all film, disc and developing/printing costs. All material used shall be used with all due precautions to avoid the possibility of accident to humans, animals and/or property. BID PRICE: All work performed shall be billed to the City of Hutchinson on the per hour bid price for performing contract mowing services as directed by the Code Enforcement Department according to the attached specifications and general conditions - this rate is not per man hour and will not be multiplied by the number of employees per hour that may work on a job, nor will hours be multiplied to include each hour that each employee may work. The quoted amount will be the (clock) hourly rate paid per job. SCHEDULE: The mowing "jobs" are to be completed within five (5) days of notification from the Inspection Sanitation Department. If contractor does not complete the jobs within five days of notification, the City reserves the right to contract with other persons to complete the jobs. In addition to mowing, there will be a few situations where the contractor will be asked to cut and/or remove brush or small trees on a property. In a few cases, there may be minor clean-up involved. NATURE OF WORK: The contractor will be required to keep accurate records, including time/date the job was started and completed, the equipment used, etc. and to submit itemized statements for such work. All itemized statements must be submitted to the Code Enforcement Department within ten (10) days of notification to begin work. In addition, the contractor will be required to take 35 mm or digital pictures of each job both before beginning and after completion with a camera that mechanically prints the date on each picture. These printing and/or developed pictures must be submitted to the Code Enforcement Department with each itemized statement. OBLIGATIONS OF CONTRACTOR: The contractor is obligated to abide by all laws governing employment including but not limited to worker's compensation insurance. All employees that are utilized by the contractor to operate machinery must be 18 years of age or older. In addition, the contractor will be required to fully compensate the City for any damage to its property resulting from work done under the mowing contract. The contractor will be obligated to indemnify the City against and hold it harmless from all third-party claims arising from his performance under the mowing contract and will maintain and hold in full force all insurance required by these bid documents. An agreement will be entered with the successful bidder(s) for an original period of one (1) calendar year, or portion of one (1) calendar year following acceptance of contract by both parties and may be renewed thereafter for a period not to exceed December 31, 2027. The fee for services shall remain firm for the entire contract period except through written petition to the Purchasing Agent of the City of Hutchinson stating reasoning for requesting the increase. This petition shall be reviewed and up to the discretion of the City for approval or disapproval. Should the petition be disapproved, termination of the contract may be initiated through the terms herein stated. This agreement may be terminated by the City upon seven (7) days written notice in the event of substantial failure by the Contractor to perform in accordance with the terms or for failing to provide reasonable service according to prevailing standards of the industry in the State and/or if the Contractor failed to meet the provision of this agreement. Either party may terminate this agreement upon thirty (30) days written notice if the other party has not provided, in the option of the party, satisfactory compliance to the agreement, and only after written notice. Performance under this agreement is subject to strikes, lockouts, wars, acts of God and any condition beyond the Contractor's control ACCEPTANCE OR REJECTION OF PROPOSALS: The City of Hutchinson reserves the right to reject any or all bids, part, or parts of any bids, and to waive formalities. The City also reserves the right to award all or any part of the order to a vendor, whichever incurs the lowest cost to the city and to abide by all City Purchasing Policies.
